Rhode Island General Laws 28-42-38.2. Income and eligibility verification
(a) The department of labor and training will participate in the income and eligibility verification procedures as required by 42 U.S.C. § 1320b-7, which provides for the exchange of information among agencies administering federally assisted programs for aid to families with dependent children, Medicaid, food stamps, supplemental security income, unemployment insurance, and any other state program under a plan approved under Title I, X, XIV, or XVI of the Social Security Act, 42 U.S.C. § 301 et seq., § 1201 et seq., § 1351 et seq., or § 1381 et seq., respectively.
Terms Used In Rhode Island General Laws 28-42-38.2
- Department: means the department of labor and training. See Rhode Island General Laws 28-29-2
- Dependent: A person dependent for support upon another.
- Director: means the director of labor and training or his or her designee unless specifically stated otherwise. See Rhode Island General Laws 28-29-2
- United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
(b) Notwithstanding any other provisions of this chapter, the director will provide, upon request: (1) Quarterly wage information to all authorized agencies for income and eligibility verification purposes and, further, to the appropriate state or local child support enforcement agency operating pursuant to a plan described in 42 U.S.C. § 654 which has been approved by the Secretary of Health and Human Services under Part D of Title IV of the Social Security Act, 42 U.S.C. § 651 et seq.; (2) Quarterly wage information for child support enforcement purposes to the Department of Health and Human Services in accordance with United States Pub. L. No. 100-485, the Family Support Act of 1988; and (3) Quarterly wage information to the Department of Housing and Urban Development and to authorized representatives of public housing agencies in accordance with the Stewart B. McKinney Homeless Assistance Act, 42 U.S.C. § 11301 et seq. This information shall be made available only to the extent necessary for the valid administrative needs of the authorized agencies and all agencies requesting this data shall protect it from unauthorized disclosures. The department shall be reimbursed by the agencies requesting the information for the costs incurred in providing the information.
