(a) Disciplinary procedures under this chapter shall be conducted in accordance with the administrative procedures act, chapter 35 of Title 42.
Terms Used In Rhode Island General Laws 5-39.1-12
- Board: means the state board of social work examiners for licensure of social workers. See Rhode Island General Laws 5-39.1-2
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-39.1-2
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
(b) The board or its designee shall hear evidence produced in support of the formal charges and contrary evidence produced by the licensee. At the conclusion of the hearing, the board shall make recommendation to the director who shall issue an order.
