- Acquired entity: means the entity, all of one or more classes or series of interests of which are acquired in an interest exchange. See Rhode Island General Laws 7-13.1-1101
- Acquiring entity: means the entity that acquires all of one or more classes or series of interests of the acquired entity in an interest exchange. See Rhode Island General Laws 7-13.1-1101
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- agency: means any executive, legislative, judicial, regulatory, or administrative body of the state or any political subdivision thereof, including, but not limited to: public officials elected or appointed; any department, division, agency, commission, board, office, bureau, authority; any school, fire, or water district; or other agency or quasi-public agency of state or local government that exercises governmental functions. See Rhode Island General Laws 5-65.1-2
- Allegation: something that someone says happened.
- Alter: means the replacing, changing, or repairing of any portion of the existing wells, water-supply systems, water-treatment systems, water-filtration systems, or pumps and the terms "alteration" and "altering" shall be construed accordingly. See Rhode Island General Laws 5-65.2-2
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appraisal: A determination of property value.
- Appurtenance: means and includes wells, pumps, filtration or treatment systems, or other devices installed therewith. See Rhode Island General Laws 5-65.2-2
- appurtenances: includes , but is not limited to, the installation, alteration, or repair of wells connected to a structure consistent with Rhode Island General Laws 5-65-1
- Associate home inspector: means a person who is employed by a licensed home inspector to conduct a home inspection of a residential building on behalf of a client for a fee under the direct supervision of the licensed home inspector and is licensed pursuant to the provisions of this chapter. See Rhode Island General Laws 5-65.1-2
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Auricular acudetox: means the subcutaneous insertion of sterile, disposable acupuncture needles in consistent, predetermined bilateral locations on the ear in accordance with the NADA protocol. See Rhode Island General Laws 5-69-2
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Board: means the Rhode Island state board of dietetics practice. See Rhode Island General Laws 5-64-3
- Board: means the certifying board for dietary managers. See Rhode Island General Laws 5-64.1-3
- Board: means the contractors' registration and licensing board established pursuant to the provisions of § 5-65-14 or its designees. See Rhode Island General Laws 5-65-1
- Board: means the contractors' registration and licensing board. See Rhode Island General Laws 5-65.1-2
- Board: means the contractors' registration and licensing board. See Rhode Island General Laws 5-65.2-2
- Board: means the contractors' registration and licensing board as defined in § 5-65-1. See Rhode Island General Laws 5-65.3-2
- board: means the board of licensing for chemical dependency professionals. See Rhode Island General Laws 5-69-2
- Certificate of limited partnership: means the certificate required by Rhode Island General Laws 7-13.1-102
- Claim: means that portion of a complaint that pertains to the complainant's assertion that they are entitled to monetary damages, an order for specific performance of work and/or other contractual or equitable relief or remedies on account of allegations or disputes between themself and a contractor or themself and a subcontractor. See Rhode Island General Laws 5-65-1
- Clergy: includes any minister, priest, rabbi, Christian Science practitioner, or any other similar religious counselor. See Rhode Island General Laws 5-69-2
- Client: means any person who engages, or seeks to engage, the services of a home inspector for the purpose of obtaining an inspection of, and written report upon, the condition of a residential building. See Rhode Island General Laws 5-65.1-2
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Complaint: means a written complaint submitted to the board or office with allegations against or disputes involving a contractor, which may contain a claim component and/or allegations that a contractor has violated provisions of this chapter or the regulations promulgated hereunder. See Rhode Island General Laws 5-65-1
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Contract for construction: means a contract for which a lien may be established under chapter 28 of Title 34 or for state or municipal public works projects as defined in title 37 on a project for which the person on whose contract with the project owner has an original contract price of not less than two hundred fifty thousand dollars ($250,000); provided, however, that "contract for construction" shall not include a project containing, or designed to contain, at least one, but not more than four (4), dwelling units. - Contractor: includes , but is not limited to, any person who purchases or owns property and constructs, or for compensation arranges for the construction of, one or more structures. See Rhode Island General Laws 5-65-1
- Conversion: means a transaction authorized by subpart 4. See Rhode Island General Laws 7-13.1-1101
- Converted entity: means the converting entity as it continues in existence after a conversion. See Rhode Island General Laws 7-13.1-1101
- Converting entity: means the domestic entity that approves a plan of conversion pursuant to Rhode Island General Laws 7-13.1-1101
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Degree: means a degree received from, or validated by, a college or university that was regionally accredited through the council on postsecondary accreditation and the U. See Rhode Island General Laws 5-64-3
- Deliverable: means a project close-out document that shall be submitted by the person seeking payment of retainage under the person's contract for construction; provided, however, that a lien waiver or release, which is a deliverable, shall comply with chapter 28 of Title 34; provided, further, that "deliverable" shall not include any document affirming, certifying, or confirming completion or correction of labor, materials, or other items furnished or incomplete or defective work. - Department: means the Rhode Island department of health. See Rhode Island General Laws 5-69-2
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Design: means the act of creating a document, either manually or electronically, that defines the layout, placement, and/or configuration of telecommunication devices, infrastructure components, and/or physical topology(s); trunking or distribution routing(s) and/or their material components; telecommunication outlet locations and/or their material components; telecommunication closet locations and/or their material components for the purpose of defining telecommunication work licensed within this chapter. See Rhode Island General Laws 5-70-3
- Dietary manager: means a person who:
(i) Integrates and applies principles with education and training at an accredited school, college, or university in purchasing, personnel practices, supervision of people, budgeting and finance, menu planning, and nutrition;
(ii) Directs and coordinates food-service activities of a hospital, nursing home, or a related facility;
(iii) Confers with dieticians to ensure that menus and department policies conform to nutritional standards and government and established regulations and procedures;
(iv) Reviews patient diet information and discusses requests, changes, and inconsistencies with the patient, professional staff, and/or resident food committee or council;
(v) Plans and coordinates through subordinate supervisors, standards and procedures of food storage, preparation, and service, department and equipment sanitation, employee safety, and personnel policies and procedures;
(vi) Inspects food and food preparation and storage areas with knowledge of health and sanitation regulations;
(vii) Tastes, smells, and observes food to ensure conformance with recipes and appearance standards;
(viii) Attends meetings with employees, department heads, administration, and dieticians to discuss regulations, procedures, grievances, and recommendations for improving food service;
(ix) Computes operating costs for own information and for information of administration;
(x) In the absence of the dietician, a certified dietary manager is responsible for the department; and
(xi) Oversees all therapeutic diets to be planned in writing, reviewed, approved, and dated by the qualified dietician. See Rhode Island General Laws 5-64.1-3
- Dietetics: means the professional discipline of applying principles derived from the sciences of nutrition, biochemistry, physiology, management, and behavioral and social sciences in the provision of dietetic services. See Rhode Island General Laws 5-64-3
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-64-3
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-69-2
- Domesticated limited partnership: means the domesticating limited partnership as it continues in existence after a domestication. See Rhode Island General Laws 7-13.1-1101
- Domesticating limited partnership: means the domestic limited partnership that approves a plan of domestication pursuant to Rhode Island General Laws 7-13.1-1101
- Domestication: means a transaction authorized by subpart 5. See Rhode Island General Laws 7-13.1-1101
- Dwelling unit: means a single unit providing complete independent-living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking, and sanitation. See Rhode Island General Laws 5-65-1
- Electrical work: means the limited electrical installation, connection, and services from a drop/wall switch, as supplied by a properly licensed electrician for water-supply systems, water-filtration systems, water-treatment systems, and pump installations. See Rhode Island General Laws 5-65.2-2
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Examination: means the registration examination for dietitians or other exam as determined by and approved by the board. See Rhode Island General Laws 5-64-3
- Experience: means six thousand (6,000) hours of supervised practice of chemical dependency counseling in a department of behavioral healthcare, developmental disabilities and hospitals licensed or ICRC/AODA member-board-approved facility during a sixty-month (60) period of time immediately preceding the date of application for licensure. See Rhode Island General Laws 5-69-2
- Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
- Filing entity: means an entity whose formation requires the filing of a public organic record. See Rhode Island General Laws 7-13.1-1101
- Finance lease: means a lease with respect to which:
(i) The lessor does not select, manufacture, or supply the goods;
(ii) The lessor acquires the goods or the right to possession and use of the goods in connection with the lease; and
(iii) One of the following occurs:
(A) The lessee receives a copy of the contract by which the lessor acquired the goods or the right to possession and use of the goods before signing the lease contract;
(B) The lessee's approval of the contract by which the lessor acquired the goods or the right to possession and use of the goods is a condition to effectiveness of the lease contract;
(C) The lessee, before signing the lease contract, receives an accurate and complete statement designating the promises and warranties, and any disclaimers of warranties, limitations or modifications of remedies, or liquidated damages, including those of a third party, such as the manufacturer of the goods, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods; or
(D) If the lease is not a consumer lease, the lessor, before the lessee signs the lease contract, informs the lessee in writing (a) of the identity of the person supplying the goods to the lessor, unless the lessee has selected that person and directed the lessor to acquire the goods or the right to possession and use of the goods from that person, (b) that the lessee is entitled under this chapter to the promises and warranties, including those of any third party, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods, and (c) that the lessee may communicate with the person supplying the goods to the lessor and receive an accurate and complete statement of those promises and warranties, including any disclaimers and limitations of them or of remedies. - Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Foreign limited partnership: means an unincorporated entity formed under the law of a jurisdiction other than this state which would be a limited partnership if formed under the law of this state. See Rhode Island General Laws 7-13.1-102
- Fraud: Intentional deception resulting in injury to another.
- General supervision: means available by telephone, cellphone, or electronic means during business hours. See Rhode Island General Laws 5-69-2
- Goods: means all things that are movable at the time of identification to the lease contract, or are fixtures (§?6A-2. See Rhode Island General Laws 6A-2.1-103
- Hearing officer: means a person designated by the director of the department of business regulation or the director's designee to hear contested cases, contested enforcement proceedings, contested administrative fines, and to render decisions or orders in accordance with the "administrative procedures act" chapter 35 of Title 42. See Rhode Island General Laws 5-65-1
- Home inspection: means an inspection and a written evaluation of the following readily visible and accessible components of a residential building: heating, cooling, plumbing, and electrical systems, structural components, foundation, roof, masonry structure, exterior and interior components, and any other related residential housing components, unless the scope of the inspection is otherwise clearly limited, in writing, in the inspection report. See Rhode Island General Laws 5-65.1-2
- Home inspector: means any person licensed as a home inspector to conduct a home inspection of a residential building on behalf of a client for a fee pursuant to the provisions of this chapter. See Rhode Island General Laws 5-65.1-2
- in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
- Incomplete or defective work: means labor, materials, or any other item required for full performance by a person seeking payment of retainage that remains to be furnished by the person under the person's contract for construction or that has been furnished by the person but requires correction, repair, further completion, revision, or replacement; provided, however, that "incomplete or defective work" shall not include deliverables or labor, materials, or any other item to be repaired or replaced after substantial or final completion pursuant to a warranty, guarantee, or other contractual obligation to correct defective work after substantial or final completion. - individual: means an individual person whether a resident of this state or not. See Rhode Island General Laws 5-64.1-3
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Interest: means :
(i) A share in a business corporation;
(ii) A membership in a nonprofit corporation;
(iii) A partnership interest in a general partnership;
(iv) A partnership interest in a limited partnership;
(v) A membership interest in a limited liability company;
(vi) A share in a general cooperative association;
(vii) A member's interest in a limited cooperative association;
(viii) A membership in an unincorporated nonprofit association;
(ix) A beneficial interest in a statutory trust, business trust, or common-law business trust; or
(x) A governance interest or distributional interest in any other type of unincorporated entity. See Rhode Island General Laws 7-13.1-1101
- Interest exchange: means a transaction authorized by subpart 3. See Rhode Island General Laws 7-13.1-1101
- Interest holder: means :
(i) A shareholder of a business corporation;
(ii) A member of a nonprofit corporation;
(iii) A general partner of a general partnership;
(iv) A general partner of a limited partnership;
(v) A limited partner of a limited partnership;
(vi) A member of a limited liability company;
(vii) A shareholder of a general cooperative association;
(viii) A member of a limited cooperative association;
(ix) A member of an unincorporated nonprofit association;
(x) A beneficiary or beneficial owner of a statutory trust, business trust, or common-law business trust; or
(xi) Any other direct holder of an interest. See Rhode Island General Laws 7-13.1-1101
- Interest holder liability: means :
(i) Personal liability for a liability of an entity which is imposed on a person:
(A) Solely by reason of the status of the person as an interest holder; or
(B) By the organic rules of the entity which make one or more specified interest holders or categories of interest holders liable in their capacity as interest holders for all or specified liabilities of the entity; or
(ii) An obligation of an interest holder under the organic rules of an entity to contribute to the entity. See Rhode Island General Laws 7-13.1-1101
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Jurisdiction of formation: means the jurisdiction whose law governs the internal affairs of an entity. See Rhode Island General Laws 7-13.1-102
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Lease: means a transfer of the right to possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Rhode Island General Laws 6A-2.1-103
- Lease agreement: means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this chapter. See Rhode Island General Laws 6A-2.1-103
- Lease contract: means the total legal obligation that results from the lease agreement as affected by this chapter and any other applicable rules of law. See Rhode Island General Laws 6A-2.1-103
- Leasehold interest: means the interest of the lessor or the lessee under a lease contract. See Rhode Island General Laws 6A-2.1-103
- Lessee: means a person who acquires the right to possession and use of goods under a lease. See Rhode Island General Laws 6A-2.1-103
- Lessor: means a person who transfers the right to possession and use of goods under a lease. See Rhode Island General Laws 6A-2.1-103
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Licensed chemical dependency clinical supervisor: means an individual licensed by the department of health to practice and supervise substance-abuse counseling and who meets the qualifications established in this chapter. See Rhode Island General Laws 5-69-2
- Licensed chemical dependency professional: means an individual licensed by the department of health to practice substance-abuse counseling and who meets the qualifications established in this chapter. See Rhode Island General Laws 5-69-2
- Lien: A claim against real or personal property in satisfaction of a debt.
- Member board: means the Rhode Island board for certification of chemical dependency professionals. See Rhode Island General Laws 5-69-2
- Merger: means a transaction authorized by subpart 2. See Rhode Island General Laws 7-13.1-1101
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Oath: A promise to tell the truth.
- oath: includes affirmation; the word "sworn" includes affirmed; and the word "engaged" includes either sworn or affirmed. See Rhode Island General Laws 43-3-11
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Office: means the state building office established pursuant to Rhode Island General Laws 5-65-1
- Organic law: means the law of an entity's jurisdiction of formation governing the internal affairs of the entity. See Rhode Island General Laws 7-13.1-1101
- Organic rules: means the public organic record and private organic rules of an entity. See Rhode Island General Laws 7-13.1-1101
- Partner: means a limited partner or general partner. See Rhode Island General Laws 7-13.1-102
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Partnership agreement: means the agreement, whether or not referred to as a partnership agreement and whether oral, implied, in a record, or in any combination thereof, of all the partners of a limited partnership concerning the matters described in Rhode Island General Laws 7-13.1-102
- Person: means any natural person, joint venture, partnership, corporation, or other business or legal entity who or that enters into a contract for construction. See Rhode Island General Laws 5-65-1
- Person: means an individual, partnership, corporation, association, limited-liability company, joint venture, or organization, or any combination thereof. See Rhode Island General Laws 5-65.2-2
- Person: means an individual, business corporation, nonprofit corporation, partnership, limited partnership, limited liability company, general cooperative association, limited cooperative association, unincorporated nonprofit association, cooperative housing corporation, workers' cooperative, producers' cooperative, consumer's cooperative, statutory trust, business trust, common-law business trust, estate, trust, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Rhode Island General Laws 7-13.1-102
- person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
- Personal property: All property that is not real property.
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Plan: means a plan of merger, plan of interest exchange, plan of conversion, or plan of domestication. See Rhode Island General Laws 7-13.1-1101
- Plan of conversion: means a plan under Rhode Island General Laws 7-13.1-1101
- Plan of domestication: means a plan under Rhode Island General Laws 7-13.1-1101
- Plan of interest exchange: means a plan under Rhode Island General Laws 7-13.1-1101
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Plumbing work: means the limited plumbing necessary for the installation of water-supply systems, pumps, water-filtration systems, and water-treatment systems. See Rhode Island General Laws 5-65.2-2
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Property: means all property, whether real, personal, or mixed or tangible or intangible, or any right or interest therein. See Rhode Island General Laws 7-13.1-102
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Protected agreement: means :
(i) A record evidencing indebtedness and any related agreement in effect on January 1, 2023;
(ii) An agreement that is binding on an entity on January 1, 2023;
(iii) The organic rules of an entity in effect on January 1, 2023; or
(iv) An agreement that is binding on any of the governors or interest holders of an entity on January 1, 2023. See Rhode Island General Laws 7-13.1-1101
- Public organic record: means the record the filing of which by the secretary of state is required to form an entity and any amendment to or restatement of that record. See Rhode Island General Laws 7-13.1-1101
- Pump installer: means a person licensed by the contractors' registration and licensing board who is employed in the placement and preparation for operation of pumps and pumping equipment and materials utilized in withdrawing or obtaining water for water-supply distribution lines, including all construction involved in making entrance to the well and establishing such seals and safeguards as may be necessary to protect such water from contamination and all construction involved in connecting such wells and pumping units or pressure tanks in the water-supply systems of structures served by such well, including repair and servicing to any existing installation. - Pumps and pumping equipment: means any equipment or materials utilized, or intended for use, in transferring, pressurizing, withdrawing, or obtaining groundwater supply including, but not limited to, seals, tanks, fittings, and controls. See Rhode Island General Laws 5-65.2-2
- Quorum: The number of legislators that must be present to do business.
- real estate: may be construed to include lands, tenements, and hereditaments and rights thereto and interests therein. See Rhode Island General Laws 43-3-10
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Registered dietician: means any person registered to practice dietetics as specified by the commission of registration of the American Dietetic Association. See Rhode Island General Laws 5-64.1-3
- Registered dietitian: means a person registered by the commission of dietetic registration. See Rhode Island General Laws 5-64-3
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- Residential building: means a structure consisting of one or more residences and their appurtenances. See Rhode Island General Laws 5-65.1-2
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Retainage: means a portion or percentage of a payment due pursuant to a contract for construction that is withheld to ensure full performance of the contract for construction. See Rhode Island General Laws 5-65-1
- Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
- seal: shall be construed to include an impression of the seal made with or without the use of wax or wafer on the paper. See Rhode Island General Laws 43-3-15
- Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- sound: means use or operation of apparatus for transmission of sounds and especially music and/or speech between distant points with or without connecting wires for broadcast or disbursement over a defined area. See Rhode Island General Laws 5-70-3
- Staff: means any staff necessary to carry out the powers, functions, and duties of the board, or the office, including inspectors, hearing officers, and other supportive staff. See Rhode Island General Laws 5-65-1
- State: means the state of Rhode Island. See Rhode Island General Laws 5-65-1
- State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Rhode Island General Laws 7-13.1-102
- Statement of conversion: means a statement under Rhode Island General Laws 7-13.1-1101
- Statement of interest exchange: means a statement under Rhode Island General Laws 7-13.1-1101
- Statute: A law passed by a legislature.
- Structure: means (i) Any commercial building; or (ii) Any building containing one or more residences and their appurtenances. See Rhode Island General Laws 5-65-1
- Subpoena: A command to a witness to appear and give testimony.
- Substance abuse: means addictive (chronic or habitual) consumption, injection, inhalation, or behavior of/with a substance (such as alcohol and drugs), progressively injuring and afflicting the user's psychological, physical, social, economic, and/or spiritual functioning. See Rhode Island General Laws 5-69-2
- Substantial completion: means the stage in the progress of the project when the work required by the contract for construction with the project owner is sufficiently complete in accordance with the contract for construction so that the project owner may occupy or utilize the work for its intended use; provided, further, that "substantial completion" may apply to the entire project or a phase of the entire project if the contract for construction with the project owner expressly permits substantial completion to apply to defined phases of the project. - Supervision: means no less than one hour per week and consists of individual or group supervision with a clinician licensed or certified in substance-abuse counseling with education, supervisory experience, and ethics approved by the ICRC/AODA member. See Rhode Island General Laws 5-69-2
- Supplier: means a person from whom a lessor buys or leases goods to be leased under a finance lease. See Rhode Island General Laws 6A-2.1-103
- Supply contract: means a contract under which a lessor buys or leases goods to be leased. See Rhode Island General Laws 6A-2.1-103
- Telecommunications systems: means any system involved in the sending and/or receiving at a distance of voice, sound, data, and/or video transmissions. See Rhode Island General Laws 5-70-3
- telephony: means use or operation of apparatus for transmission of sounds and especially speech between distant points with or without connecting wires. See Rhode Island General Laws 5-70-3
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9
- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Type of entity: means a generic form of entity:
(i) Recognized at common law; or
(ii) Formed under an organic law, whether or not some entities formed under that organic law are subject to provisions of that law that create different categories of the form of entity. See Rhode Island General Laws 7-13.1-1101
- Underground utility: means the installation, repair, alteration, or replacement of underground utilities, sewer lines, storm drainage lines or water lines, water service and laterals, laying drains and related services outside of buildings, making connections with public and/or private underground utilities, provided that such work is to be done between the main, lateral, related services and/or appurtenances to within five feet (5?) of the outer wall of a building or structure and specifically excluding gas and telecommunications work and any work defined in § 28-27-28. - Underground utility contractor: means any corporation, association, sole proprietorship, firm, partnership, limited-liability corporation, limited-liability partnership, or other business organization that is engaged in the installation, repair, alteration, or replacement of underground utilities, outside of buildings, making connections with public and/or private underground utilities, provided that such work is to be done between the main, laterals, services and/or appurtenances to within five feet (5?) of the outer walls of a building or structure. - United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
- Violation: means a violation of any provision of this chapter or the regulations promulgated hereunder or any order of the board or office. See Rhode Island General Laws 5-65-1
- Water-supply system: means and includes any apparatus, equipment, water service pipes, water distribution pipes, and the necessary connecting pipes, control valves, and all appurtenances adjacent to the structure or premises, including the supply of water to the main water distribution line, geothermal, and all other water needs that require storage, pumping, treatment, filtration, or alteration in any way. See Rhode Island General Laws 5-65.2-2
- Well: means an artificial sanitary excavation or opening in the ground by which groundwater can be obtained or through which it flows under natural pressure or is artificially withdrawn; and for the purposes of this chapter attached as an appurtenance to a building or structure. See Rhode Island General Laws 5-65.2-2
- Well drilling: means all acts necessary for the construction, installation, or alteration of a water-supply well or to obtain water from a well or wells by drilling, or by excavation that is drilled, cored, bored, washed, driven, dug, jetted, or otherwise constructed. See Rhode Island General Laws 5-65.2-2
- Well-drilling contractor: means a person who is licensed by the contractors' registration and licensing board and engages in well drilling, including the installation, alteration, removal, or repair of water-supply systems. See Rhode Island General Laws 5-65.2-2
