- Acquired entity: means the entity, all of one or more classes or series of interests of which are acquired in an interest exchange. See Rhode Island General Laws 7-12.1-1101
- Acquired entity: means the entity, all of one or more classes or series of interests of which are acquired in an interest exchange. See Rhode Island General Laws 7-13.1-1101
- Acquiring entity: means the entity that acquires all of one or more classes or series of interests of the acquired entity in an interest exchange. See Rhode Island General Laws 7-12.1-1101
- Act: means chapter 48 of this title entitled, "speech-language pathology and audiology" as well as the provisions of this chapter, where the context so indicates. See Rhode Island General Laws 5-48.2-3
- Administrator: means the administrator, division of professional regulation. See Rhode Island General Laws 5-54-2
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appraisal: A determination of property value.
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
- Audiologist: means an individual licensed by the board to practice audiology. See Rhode Island General Laws 5-48-1
- Audiologist: means an individual who is licensed by the board to practice audiology either in person or via telepractice. See Rhode Island General Laws 5-48.2-3
- Audiologist: means an individual licensed to practice audiology by the department of health. See Rhode Island General Laws 5-49-1
- Audiology: means the application of principles, methods, and procedures related to hearing and the disorders of the hearing and balance systems, to related language and speech disorders, and to aberrant behavior related to hearing loss. See Rhode Island General Laws 5-48-1
- Audiology: means the audiologist applies the principles, methods, and procedures related to hearing and the disorders of the hearing and balance systems, to related language and speech disorders, and to aberrant behavior related to hearing loss. See Rhode Island General Laws 5-48.2-3
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Bequest: Property gifted by will.
- Board: means the board of psychology established by § 5-44-3. See Rhode Island General Laws 5-44-1
- Board: means the state board of examiners of speech-language pathology and audiology. See Rhode Island General Laws 5-48-1
- Board: means the state board of examiners of speech-language pathology and audiology established pursuant to § 5-48-2. See Rhode Island General Laws 5-48.2-3
- Board: means the board of hearing aid dealers and fitters. See Rhode Island General Laws 5-49-1
- Board: means the Rhode Island state board of examiners of landscape architects. See Rhode Island General Laws 5-51-1
- Board: means the board of licensure of physician assistants. See Rhode Island General Laws 5-54-2
- Brand: means a term, design, or trademark used in connection with one or several grades of commercial fertilizer. See Rhode Island General Laws 2-7-3
- Business: includes every trade, occupation, and profession. See Rhode Island General Laws 7-12.1-102
- Business day: means any day except Sunday or a legal holiday. See Rhode Island General Laws 5-50-1
- Buyer: means a person who buys or contracts to buy goods. See Rhode Island General Laws 6A-2-103
- Certificate of limited partnership: means the certificate required by Rhode Island General Laws 7-13.1-102
- Charitable organization: means any organization soliciting for a charitable purpose or any organization holding themselves out as such. See Rhode Island General Laws 5-53.1-1
- Charitable purpose: means , but is not limited to, any benevolent, educational, humane, patriotic, social service, civic, philanthropic, scientific, literary, or eleemosynary purpose. See Rhode Island General Laws 5-53.1-1
- Clinical fellow: means the person who is practicing speech-language pathology under the supervision of a licensed speech-language pathologist while completing the postgraduate professional experience as required by this chapter. See Rhode Island General Laws 5-48-1
- Clinical fellow: means the person who is practicing speech-language pathology under the supervision of a licensed speech-language pathologist while completing the postgraduate professional experience as required by the act and who holds a current provisional license in accordance with the requirements described in this chapter. See Rhode Island General Laws 5-48.2-3
- Collaboration: means the physician assistant shall, as indicated by the patient's condition, the education, competencies, and experience of the physician assistant, and the standards of care, consult with or refer to an appropriate physician or other healthcare professional. See Rhode Island General Laws 5-54-2
- Commercial fertilizer: means any substance containing one or more recognized plant nutrient(s) that is used for its plant nutrient content and that is designed for use or claimed to have value in promoting plant growth, except unmanipulated animal and vegetable manures, marl, lime, limestone, wood ashes and gypsum, and other products exempted by regulation of the director. - Commercial unit: means such a unit of goods as by commercial usage is a single whole for purposes of lease and division of which materially impairs its character or value on the market or in use. See Rhode Island General Laws 6A-2.1-103
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Consumer lease: means a lease that a lessor regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family, or household purpose. See Rhode Island General Laws 6A-2.1-103
- Contract: A legal written agreement that becomes binding when signed.
- Contract for sale: includes both a present sale of goods and a contract to sell goods at a future time. See Rhode Island General Laws 6A-2-106
- Contribution: means the promise or grant of any money, property, or anything of value obtained through solicitation, except payments by members of any organization for fees, dues, fines, assessments, or for services rendered to individual members. See Rhode Island General Laws 5-53.1-1
- Conversion: means a transaction authorized by Rhode Island General Laws 7-12.1-1101
- Conversion: means a transaction authorized by subpart 4. See Rhode Island General Laws 7-13.1-1101
- Converted entity: means the converting entity as it continues in existence after a conversion. See Rhode Island General Laws 7-12.1-1101
- Converting entity: means the domestic entity that approves a plan of conversion pursuant to Rhode Island General Laws 7-12.1-1101
- Converting entity: means the domestic entity that approves a plan of conversion pursuant to Rhode Island General Laws 7-13.1-1101
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Decedent: A deceased person.
- Department: means the Rhode Island department of health. See Rhode Island General Laws 5-44-1

- Deposit in advance: means any deposit, regardless of its purported purpose, that is received by a distributor or refiner from a retail dealer or distributor as a breakage, security, or other similar deposit. See Rhode Island General Laws 5-55-3
- Devise: To gift property by will.
- Director: means director of the department of environmental management or his or her authorized agent. See Rhode Island General Laws 2-7-3
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-44-1
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-48-1
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-48.1-2
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 5-48.2-3
- Director: means the director of the department of business regulation or his or her designee. See Rhode Island General Laws 5-51-1
- Director: means the director of the department. See Rhode Island General Laws 5-53.1-1
- Director: means the director of the department of health. See Rhode Island General Laws 5-54-2
- Disability: means a condition that will exist for more than forty-five (45) days and prevents a buyer from utilizing the health club to the same extent the buyer did before the commencement of the condition. See Rhode Island General Laws 5-50-1
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Distributional interest: means the right under an unincorporated entity's organic law and organic rules to receive distributions from the entity. See Rhode Island General Laws 7-13.1-1101
- Distributor: means any person who imports, consigns, manufactures, produces, compounds, mixes, or blends commercial fertilizer, or who offers for sale, sells, barters, or otherwise supplies commercial fertilizer in this state. See Rhode Island General Laws 2-7-3
- Distributor: means any person engaged in the sale, consignment, or distribution of petroleum products to wholesale or retail outlets, whether or not that person owns, leases, or in any way controls those outlets. See Rhode Island General Laws 5-55-3
- Division: means the division of professional regulation, department of health. See Rhode Island General Laws 5-54-2
- Domesticated limited liability partnership: means a domesticating limited liability partnership as it continues in existence after a domestication. See Rhode Island General Laws 7-12.1-1101
- Domesticating limited liability partnership: means the domestic limited liability partnership that approves a plan of domestication pursuant to Rhode Island General Laws 7-12.1-1101
- Domestication: means a transaction authorized by Rhode Island General Laws 7-12.1-1101
- Domestication: means a transaction authorized by subpart 5. See Rhode Island General Laws 7-13.1-1101
- Donor: The person who makes a gift.
- Education: means the academic program pursued by a person in obtaining a doctoral degree, that program to include formal course work, seminars, and practica. See Rhode Island General Laws 5-44-1
- Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Executive session: A portion of the Senate's daily session in which it considers executive business.
- Facility: means any healthcare facility licensed by the department of health or the department of behavioral healthcare, developmental disabilities and hospitals under the provisions of title 23 and title 40. See Rhode Island General Laws 5-48.1-2
- Fiduciary: A trustee, executor, or administrator.
- Filing entity: means an entity whose formation requires the filing of a public organic record. See Rhode Island General Laws 7-12.1-1101
- Finance lease: means a lease with respect to which:
(i) The lessor does not select, manufacture, or supply the goods;
(ii) The lessor acquires the goods or the right to possession and use of the goods in connection with the lease; and
(iii) One of the following occurs:
(A) The lessee receives a copy of the contract by which the lessor acquired the goods or the right to possession and use of the goods before signing the lease contract;
(B) The lessee's approval of the contract by which the lessor acquired the goods or the right to possession and use of the goods is a condition to effectiveness of the lease contract;
(C) The lessee, before signing the lease contract, receives an accurate and complete statement designating the promises and warranties, and any disclaimers of warranties, limitations or modifications of remedies, or liquidated damages, including those of a third party, such as the manufacturer of the goods, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods; or
(D) If the lease is not a consumer lease, the lessor, before the lessee signs the lease contract, informs the lessee in writing (a) of the identity of the person supplying the goods to the lessor, unless the lessee has selected that person and directed the lessor to acquire the goods or the right to possession and use of the goods from that person, (b) that the lessee is entitled under this chapter to the promises and warranties, including those of any third party, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods, and (c) that the lessee may communicate with the person supplying the goods to the lessor and receive an accurate and complete statement of those promises and warranties, including any disclaimers and limitations of them or of remedies. - Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Foreign limited liability partnership: means a foreign partnership whose partners have limited liability for the debts, obligations, or other liabilities of the foreign partnership under a provision similar to Rhode Island General Laws 7-12.1-102
- Foreign limited partnership: means an unincorporated entity formed under the law of a jurisdiction other than this state which would be a limited partnership if formed under the law of this state. See Rhode Island General Laws 7-13.1-102
- Foreign partnership: means an unincorporated entity formed under the law of a jurisdiction other than this state which would be a partnership if formed under the law of this state. See Rhode Island General Laws 7-12.1-102
- Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
- Franchise agreement: means any written or oral agreement, for a definite or indefinite period, between a refiner and a retail dealer or between a distributor and a retail dealer or between a refiner and a distributor under which:
(i) A retail dealer or a distributor promises to sell or distribute the product or products of the refiner;
(ii) A retail dealer or a distributor is granted the right to use a trademark, trade name, service mark, or other identifying symbol or name owned by a refiner; or
(iii) A retail dealer or a distributor is granted the right to occupy premises owned, leased, or controlled by a refiner or distributor. See Rhode Island General Laws 5-55-3
- Franchisee: means either a distributor who or that has entered into a franchise agreement with a refiner, or a retail dealer who has entered into a franchise agreement with a distributor or a refiner. See Rhode Island General Laws 5-55-3
- Franchisor: means either a refiner who or that enters into a franchise agreement with a distributor or retail dealer, or a distributor who enters into a franchise agreement with a retail dealer. See Rhode Island General Laws 5-55-3
- Fraud: Intentional deception resulting in injury to another.
- Fundraising counsel: means any person who for compensation consults with a charitable organization or who plans, manages, advises, or assists with respect to the solicitation of contributions for or on behalf of a charitable organization, but who does not have access to contributions or other receipts from a solicitation and who does not solicit. See Rhode Island General Laws 5-53.1-1
- General partner: means a person that:
(i) Has become a general partner under Rhode Island General Laws 7-13.1-102
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Goods: means all things that are movable at the time of identification to the lease contract, or are fixtures (§?6A-2. See Rhode Island General Laws 6A-2.1-103
- Governance interest: means a right under the organic law or organic rules of an unincorporated entity, other than as a governor, agent, assignee, or proxy, to:
(i) Receive or demand access to information concerning, or the books and records of, the entity;
(ii) Vote for or consent to the election of the governors of the entity; or
(iii) Receive notice of or vote on or consent to an issue involving the internal affairs of the entity. See Rhode Island General Laws 7-13.1-1101
- Governor: means :
(i) A director of a business corporation or an officer of a business corporation that has no board of directors;
(ii) A director or trustee of a nonprofit corporation;
(iii) A general partner of a general partnership;
(iv) A general partner of a limited partnership;
(v) A manager of a manager-managed limited liability company;
(vi) A member of a member-managed limited liability company;
(vii) A director of a general cooperative association;
(viii) A director of a limited cooperative association;
(ix) A manager of an unincorporated nonprofit association;
(x) A trustee of a statutory trust, business trust, or common-law business trust; or
(xi) Any other person under whose authority the powers of an entity are exercised and under whose direction the activities and affairs of the entity are managed pursuant to the organic law and organic rules of the entity. See Rhode Island General Laws 7-13.1-1101
- Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
- Grade: means the percentage of total nitrogen, available phosphorus or phosphoric acid, and soluble potassium or soluble potash stated in whole numbers in the same terms, order, and percentages as in the guaranteed analysis. See Rhode Island General Laws 2-7-3
- Guaranteed analysis: means :
(i) Until the director prescribes the alternative form of guaranteed analysis in accordance with the provisions of subdivision (7)(ii) of this section, the term "guaranteed analysis" shall mean the minimum percentage of plant nutrients claimed in the following order and form:
(A) Total Nitrogen (N). See Rhode Island General Laws 2-7-3
- Health club: means any corporation, partnership, unincorporated association, or other business enterprise offering facilities for the preservation, maintenance, encouragement, or development of physical fitness or well-being in return for the payment of a fee entitling the payer to the use of the facilities. See Rhode Island General Laws 5-50-1
- Health club contract: means a written statement where a buyer is entitled to membership in a health club or use of the facilities of a health club for a period longer than seven (7) days. See Rhode Island General Laws 5-50-1
- Healthcare provider: means any person licensed, registered, or certified by this state to provide, or lawfully providing healthcare services. See Rhode Island General Laws 5-48.1-2
- Healthcare services: means acts of diagnosis, treatment, medical evaluation, or counseling, or any other acts that may be permissible under the healthcare licensing statutes of this state. See Rhode Island General Laws 5-48.1-2
- Hearing aid: means any wearable instrument or device designed for or offered for the purpose of aiding or compensating for impaired human hearing, and any parts, attachments, or accessories, including ear molds, but excluding batteries and cords. See Rhode Island General Laws 5-49-1
- in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Interest: means :
(i) A share in a business corporation;
(ii) A membership in a nonprofit corporation;
(iii) A partnership interest in a general partnership;
(iv) A partnership interest in a limited partnership;
(v) A membership interest in a limited liability company;
(vi) A share in a general cooperative association;
(vii) A member's interest in a limited cooperative association;
(viii) A membership in an unincorporated nonprofit association;
(ix) A beneficial interest in a statutory trust, business trust, or common-law business trust; or
(x) A governance interest or distributional interest in any other type of unincorporated entity. See Rhode Island General Laws 7-12.1-1101
- Interest: means :
(i) A share in a business corporation;
(ii) A membership in a nonprofit corporation;
(iii) A partnership interest in a general partnership;
(iv) A partnership interest in a limited partnership;
(v) A membership interest in a limited liability company;
(vi) A share in a general cooperative association;
(vii) A member's interest in a limited cooperative association;
(viii) A membership in an unincorporated nonprofit association;
(ix) A beneficial interest in a statutory trust, business trust, or common-law business trust; or
(x) A governance interest or distributional interest in any other type of unincorporated entity. See Rhode Island General Laws 7-13.1-1101
- Interest exchange: means a transaction authorized by Rhode Island General Laws 7-12.1-1101

- Interest holder: means :

- Interest holder liability: means :
(i) Personal liability for a liability of an entity which is imposed on a person:
(A) Solely by reason of the status of the person as an interest holder; or
(B) By the organic rules of the entity which make one or more specified interest holders or categories of interest holders liable in their capacity as interest holders for all or specified liabilities of the entity; or
(ii) An obligation of an interest holder under the organic rules of an entity to contribute to the entity. See Rhode Island General Laws 7-12.1-1101
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Jurisdiction of formation: means the jurisdiction whose law governs the internal affairs of an entity. See Rhode Island General Laws 7-12.1-102

- Label: means the display of all written, printed, or graphic matter upon the immediate container or statement accompanying a commercial fertilizer. See Rhode Island General Laws 2-7-3
- Labeling: means all written, printed, or graphic matter, upon or accompanying any commercial fertilizer, or advertisements, brochures, posters, television, and radio announcements used in promoting the sale of commercial fertilizers. See Rhode Island General Laws 2-7-3
- Landscape architect: means a person who engages or offers to engage in the practice of landscape architecture. See Rhode Island General Laws 5-51-1
- Landscape architecture: means planning and designing the use, allocation, and arrangement of land and water resources, through the creative application of biological, physical, mathematical, and social processes. See Rhode Island General Laws 5-51-1
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Lease: means a transfer of the right to possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Rhode Island General Laws 6A-2.1-103
- Lease agreement: means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this chapter. See Rhode Island General Laws 6A-2.1-103
- Lease contract: means the total legal obligation that results from the lease agreement as affected by this chapter and any other applicable rules of law. See Rhode Island General Laws 6A-2.1-103
- Leasehold interest: means the interest of the lessor or the lessee under a lease contract. See Rhode Island General Laws 6A-2.1-103
- Lessee: means a person who acquires the right to possession and use of goods under a lease. See Rhode Island General Laws 6A-2.1-103
- Lessor: means a person who transfers the right to possession and use of goods under a lease. See Rhode Island General Laws 6A-2.1-103
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- License: means a license issued by the state under this chapter to hearing aid dealers and fitters. See Rhode Island General Laws 5-49-1
- Licensed psychologist: means a person who has been licensed for the practice of psychology under this chapter. See Rhode Island General Laws 5-44-1
- Limited partner: means a person that:
(i) Has become a limited partner under Rhode Island General Laws 7-13.1-102
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Membership: means the collective body of any charitable organization comprised of persons having voting rights and other powers of governance and who derive a direct benefit or privilege as a member thereof. See Rhode Island General Laws 5-53.1-1
- Merger: means a transaction authorized by Rhode Island General Laws 7-12.1-1101

- Merging entity: means an entity that is a party to a merger and exists immediately before the merger becomes effective. See Rhode Island General Laws 7-13.1-1101
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Official sample: means any sample of commercial fertilizer taken by the director or his or her agent and designated as "official" by the director. See Rhode Island General Laws 2-7-3
- Organic law: means the law of an entity's jurisdiction of formation governing the internal affairs of the entity. See Rhode Island General Laws 7-12.1-1101

- Oversight: Committee review of the activities of a Federal agency or program.
- Partner: means a person that:
(i) Has become a partner in a partnership under Rhode Island General Laws 7-12.1-102

- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Partnership agreement: means the agreement, whether or not referred to as a partnership agreement and whether oral, implied, in a record, or in any combination thereof, of all the partners of a partnership concerning the matters described in Rhode Island General Laws 7-12.1-102
- Partnership agreement: means the agreement, whether or not referred to as a partnership agreement and whether oral, implied, in a record, or in any combination thereof, of all the partners of a limited partnership concerning the matters described in Rhode Island General Laws 7-13.1-102
- percentage: means the percentage by weight. See Rhode Island General Laws 2-7-3
- Person: includes individual, partnership, association, firm, and corporation. See Rhode Island General Laws 2-7-3
- Person: means an individual, partnership, organization, or corporation, except that only individuals can be licensed under this chapter. See Rhode Island General Laws 5-48-1
- Person: means any individual, trust or estate, partnership, corporation (including associations, joint stock companies, and insurance companies), state, or political subdivision or instrumentality of a state. See Rhode Island General Laws 5-48.1-2
- Person: means an individual, partnership organization, or corporation, except that only individuals can be licensed under this chapter. See Rhode Island General Laws 5-48.2-3
- Person: means and shall include any individual, organization, group, association, partnership, corporation, trust, limited-liability company, and combination of the foregoing, however formed, as well as any and all other entities, however formed. See Rhode Island General Laws 5-53.1-1
- Person: means any natural person, corporation, partnership, trust, or other entity, and, in the case of any entity, the term also includes any other entity that has a majority interest in the entity or effectively controls the entity, the officers, directors, and other persons in active control of each entity. - Person: means an individual, business corporation, nonprofit corporation, partnership, limited partnership, limited liability company, general cooperative association, limited cooperative association, unincorporated nonprofit association, cooperative housing corporation, workers' cooperative, producers' cooperative, consumer's cooperative, statutory trust, business trust, common-law business trust, estate, trust, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Rhode Island General Laws 7-13.1-102
- person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
- Physician: means a person licensed under the provisions of chapter 29 or 37 of this title. See Rhode Island General Laws 5-54-2
- Place of business: means :
(i) Any fixed geographical location at which, pursuant to a franchise agreement, motor fuels are sold or distributed or a trademark, trade name, service mark, or other identifying symbol is used or displayed; or
(ii) Any premises owned, leased, or controlled by a refiner or distributor, in which a retail dealer or a distributor is granted the right of occupancy pursuant to a franchise agreement. See Rhode Island General Laws 5-55-3
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Plan: means a plan of merger, plan of interest exchange, plan of conversion, or plan of domestication. See Rhode Island General Laws 7-12.1-1101

- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Practice of audiology: means rendering or offering to render any service in audiology, including prevention, screening, and identification, evaluation, habilitation, rehabilitation; participating in environmental and occupational hearing-conservation programs, and habilitation and rehabilitation programs including hearing aid and assistive-listening-device evaluation, prescription, preparation, dispensing, and/or selling and orientation; auditory training and speech reading; conducting and interpreting tests of vestibular function and nystagmus; conducting and interpreting electrophysiological measures of the auditory pathway; cerumen management; evaluating sound environment and equipment; calibrating instruments used in testing and supplementing auditory function; and planning, directing, conducting, or supervising programs that render or offer to render any service in audiology. See Rhode Island General Laws 5-48-1
- Practice of fitting and dealing in hearing aids: means the evaluation and measurement of human hearing by means of an audiometer or by any other means solely for the purpose of making selections, adaptations, or sale of hearing aids, including ordering the use of hearing aids. See Rhode Island General Laws 5-49-1
- Practice of psychology: means the rendering of professional psychological services to individuals, groups, families, or any public or private organization for remuneration. See Rhode Island General Laws 5-44-1
- Practice of speech-language pathology: means rendering or offering to render any service in speech-language pathology including prevention, identification, evaluation, consultation, habilitation, rehabilitation; determining the need for augmentative communication systems, dispensing and selling these systems, and providing training in the use of these systems; and planning, directing, conducting, or supervising programs that render or offer to render any service in speech-language pathology. - practice of speech-language pathology: means rendering or offering to render any service in speech-language pathology either in person or via telepractice as defined in this section. See Rhode Island General Laws 5-48.2-3
- Private organic rules: means the rules, whether or not in a record, that govern the internal affairs of an entity, are binding on all its interest holders, and are not part of its public organic record, if any. See Rhode Island General Laws 7-13.1-1101
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Professional fundraiser: means any person who directly or indirectly for compensation or other consideration plans, manages, conducts, carries on, or assists in connection with a solicitation for charitable purposes or individually solicits or who or that employs or otherwise engages on any basis another person to solicit for or on behalf of any charitable organization, or who or that engages in the business of, or holds himself, herself, or itself out to persons as independently engaged in the business of soliciting for the charitable purpose. See Rhode Island General Laws 5-53.1-1
- Professional solicitor: means any person who is employed or retained for compensation by a professional fundraiser to solicit contributions for charitable purposes. See Rhode Island General Laws 5-53.1-1
- Property: means all property, whether real, personal, or mixed or tangible or intangible, or any right or interest therein. See Rhode Island General Laws 7-12.1-102

- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Protected agreement: means :
(i) A record evidencing indebtedness and any related agreement in effect on January 1, 2023;
(ii) An agreement that is binding on an entity on January 1, 2023;
(iii) The organic rules of an entity in effect on January 1, 2023; or
(iv) An agreement that is binding on any of the governors or interest holders of an entity on January 1, 2023. See Rhode Island General Laws 7-12.1-1101
- Psychologist: as used in this chapter means a licensed psychologist as defined in this section. See Rhode Island General Laws 5-44-1
- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- Public organic record: means the record the filing of which by the secretary of state is required to form an entity and any amendment to or restatement of that record. See Rhode Island General Laws 7-12.1-1101

- Purchase: includes taking by sale, lease, mortgage, security interest, pledge, gift, or any other voluntary transaction creating an interest in goods. See Rhode Island General Laws 6A-2.1-103
- purchaser: means a natural person who enters into a health club contract. See Rhode Island General Laws 5-50-1
- Quorum: The number of legislators that must be present to do business.
- real estate: may be construed to include lands, tenements, and hereditaments and rights thereto and interests therein. See Rhode Island General Laws 43-3-10
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Refiner: means any person engaged in the refining or importing of petroleum products. See Rhode Island General Laws 5-55-3
- Regionally accredited: means the official guarantee that a college or university or other educational institution is in conformity with the standards of education prescribed by a regional accrediting commission recognized by the United States Secretary of Education. See Rhode Island General Laws 5-48-1

- Registered foreign entity: means a foreign entity that is registered to do business in this state pursuant to a record filed by the secretary of state. See Rhode Island General Laws 7-12.1-1101
- Registrant: means the person who registers commercial fertilizer under the provisions of this chapter. See Rhode Island General Laws 2-7-3
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Retail dealer: means any person who operates a service station, filling station, store, garage, or other place of business for the sale of motor fuel for delivery into the service tank or tanks of any vehicle propelled by an internal combustion engine. See Rhode Island General Laws 5-55-3
- sale: means any transfer of title or of the right to use by lease, bailment, or any other contract, excluding wholesale transactions with distributors or dealers. See Rhode Island General Laws 5-49-1
- seal: shall be construed to include an impression of the seal made with or without the use of wax or wafer on the paper. See Rhode Island General Laws 43-3-15
- Seller: means any person, firm, corporation, partnership, unincorporated association, franchise, franchisor, or other business enterprise that operates a health club or offers or enters into contracts for health club services. See Rhode Island General Laws 5-50-1
- Seller: means a person who sells or contracts to sell goods. See Rhode Island General Laws 6A-2-103
- Senior-level executive employee: means any employee of a charitable organization whose compensation is in excess of the amount specified as requiring disclosure on United States Internal Revenue Service Form 990 (or the appropriate successor form by whatever name or number it may be called or designated). See Rhode Island General Laws 5-53.1-1
- Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- solicitation: means to appeal or request, directly or indirectly, whether express or implied, for money, credit, property, financial assistance, or any other thing of value by means of mail, personal contact, written material, radio, telephone, television, news media, magazines or other periodicals, or any other means of plea or representation that the money, credit, property, financial assistance, or other thing of value will be used for a charitable purpose. See Rhode Island General Laws 5-53.1-1
- Speech-language pathologist: means an individual who is licensed by the board to practice speech-language pathology. See Rhode Island General Laws 5-48-1
- Speech-language pathologist: means an individual who is licensed by the board to practice speech-language pathology either in person or via telepractice. See Rhode Island General Laws 5-48.2-3
- Speech-language pathology: means the application of principles, methods, and procedures for prevention, identification, evaluation, consultation, habilitation, rehabilitation, instruction, and research related to the development and disorders of human communication. See Rhode Island General Laws 5-48-1
- Speech-language pathology: means the activities defined in § 5-48-1 and in this section. See Rhode Island General Laws 5-48.2-3
- State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Rhode Island General Laws 7-12.1-102

- Statement of conversion: means a statement under Rhode Island General Laws 7-12.1-1101

- Statement of interest exchange: means a statement under Rhode Island General Laws 7-12.1-1101
- Statute: A law passed by a legislature.
- Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
- Sublease: means a lease of goods the right to possession and use of which was acquired by the lessor as a lessee under an existing lease. See Rhode Island General Laws 6A-2.1-103
- Subpoena: A command to a witness to appear and give testimony.
- Subpoena duces tecum: A command to a witness to produce documents.
- Summons: Another word for subpoena used by the criminal justice system.
- Surviving entity: means the entity that continues in existence after or is created by a merger. See Rhode Island General Laws 7-13.1-1101
- Telepractice: means the use of telecommunication technology to deliver speech-language pathology and audiology services remotely. See Rhode Island General Laws 5-48.2-3
- Temporary permit: means a permit issued while the applicant is in training to become a licensed hearing aid dealer and fitter. See Rhode Island General Laws 5-49-1
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Ton: means a net weight of two thousand (2,000) pounds avoirdupois. See Rhode Island General Laws 2-7-3
- town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9
- Training: means the pre-professional or professional-supervised experience received by the person at the pre- or post-doctoral level, that experience to have been obtained in an internship, clinic, or other similar professional setting. See Rhode Island General Laws 5-44-1
- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Transfer: includes :
(i) An assignment;
(ii) A conveyance;
(iii) A sale;
(iv) A lease;
(v) An encumbrance, including a mortgage or security interest;
(vi) A gift; and
(vii) A transfer by operation of law. See Rhode Island General Laws 7-12.1-102
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trustee: A person or institution holding and administering property in trust.
- Type of entity: means a generic form of entity:
(i) Recognized at common law; or
(ii) Formed under an organic law, whether or not some entities formed under that organic law are subject to provisions of that law that create different categories of the form of entity. See Rhode Island General Laws 7-12.1-1101
- Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC

- Unprofessional conduct: includes , but is not limited to, the following items or any combination and may be defined by regulations established by the board with prior approval of the director:
(i) Fraudulent or deceptive procuring or use of a license;
(ii) Representation of himself or herself as a physician;
(iii) Conviction of a felony; conviction of a crime arising out of the practice of medicine. See Rhode Island General Laws 5-54-2
- Venue: The geographical location in which a case is tried.
