Terms Used In Rhode Island General Laws > Chapter 4-2 - Commercial Feeds

  • ADA: means the American with Disabilities Act, Rhode Island General Laws 16-107-4
  • Advanced placement: means a college-level class taught at the high school level that provides students the opportunity to earn college credit upon passage of an exam that:

    (i)  Incorporates all topics specified by the College Board on its standards syllabus for a given subject area; and

    (ii)  Is authorized by the College Board. See Rhode Island General Laws 16-98-2

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Brand name: means any word, name, symbol, or device, or any combination identifying the commercial feed of a distributor or registrant and distinguishing it from that of others. See Rhode Island General Laws 4-2-3
  • Business: includes every trade, occupation, and profession. See Rhode Island General Laws 7-12.1-102
  • College Board: means and refers to the nonprofit organization that develops and administers standardized tests and curricula used by kindergarten through grade twelve (K-12) and postsecondary education institutions to promote college readiness. See Rhode Island General Laws 16-98-2
  • Commercial feed: means all materials except whole seeds unmixed or physically altered entire unmixed seeds, when not adulterated within the meaning of § 4-2-7, which are distributed for use as feed or for mixing in feed. See Rhode Island General Laws 4-2-3
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract feeder: means a person who as an independent contractor, feeds commercial feed to animals pursuant to a contract whereby that commercial feed is supplied, furnished, or otherwise provided to that person and whereby that person's remuneration is determined all or in part by feed consumption, mortality, profits, or amount or quality of product. See Rhode Island General Laws 4-2-3
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Customer formula feed: means commercial feed which consists of a mixture of commercial feeds and/or ingredients each batch of which is manufactured according to the specific instructions of the final purchaser. See Rhode Island General Laws 4-2-3
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Rhode Island department of elementary and secondary education. See Rhode Island General Laws 16-98-2
  • Dependent: A person dependent for support upon another.
  • Distribute: means to offer for sale, sell, exchange, or barter, commercial feed; or to supply, furnish, or otherwise provide commercial feed to a contract feeder. See Rhode Island General Laws 4-2-3
  • Distributor: means any person who distributes. See Rhode Island General Laws 4-2-3
  • Drug: means any article intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in animals other than humans and articles other than feed intended to affect the structure or any function of the animal body. See Rhode Island General Laws 4-2-3
  • Eligible teacher: means a professional employee who is certified in the subject area of the advanced placement course that he or she will be teaching. See Rhode Island General Laws 16-98-2
  • Entity: means the Rhode Island department of elementary and secondary education, its subagencies and state agency(s) and local municipalities from which it collects demographic data. See Rhode Island General Laws 16-108-2
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • exam: means the test provided by the College Board to measure a student's mastery of the advanced placement subject matter. See Rhode Island General Laws 16-98-2
  • FAFSA: means the Free Application for Federal Student Aid form;

    (3)  "Mandatory fees and tuition" are the costs that every student is required to pay in order to enroll in classes, and does not include room and board, textbooks, program fees that may exist in some majors, course fees that may exist for some specific courses, meal plans, or travel;

    (4)  "On track to graduate on time" means the standards determined by the community college of Rhode Island in establishing the expectation of a student to graduate with an associate's degree within two (2) years of enrollment (recognizing that some students, including students who require developmental education, are double majors, or are enrolled in certain professional programs may require an extended time period for degree completion);

    (5)  "Reasonable accommodations" means any necessary modifications or adjustment to a facility, equipment, program, or manner of operation as required by the Americans with Disabilities Act ("ADA") and section 504 of the Rehabilitation Act of 1973, Rhode Island General Laws 16-107-4

  • Feed ingredient: means each of the constituent materials making up a commercial feed. See Rhode Island General Laws 4-2-3
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Label: means a display of written, printed, or graphic matter upon or affixed to the container in which a commercial feed is distributed, or on the invoice or delivery slip with which a commercial feed is distributed. See Rhode Island General Laws 4-2-3
  • Labeling: means all labels and other written, printed, or graphic matter:

    (i)  Upon a commercial feed or any of its containers or wrapper; or

    (ii)  Accompanying that commercial feed. See Rhode Island General Laws 4-2-3

  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Manufacture: means to grind, mix, or blend, or further process a commercial feed for distribution. See Rhode Island General Laws 4-2-3
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Official sample: means a sample of feed taken by the director or his or her agent in accordance with § 4-2-10(c), (e), or (f). See Rhode Island General Laws 4-2-3
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partner: means a person that:

    (i)  Has become a partner in a partnership under Rhode Island General Laws 7-12.1-102

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Partnership agreement: means the agreement, whether or not referred to as a partnership agreement and whether oral, implied, in a record, or in any combination thereof, of all the partners of a partnership concerning the matters described in Rhode Island General Laws 7-12.1-102
  • Partnership at will: means a partnership in which the partners have not agreed to remain partners until the expiration of a definite term or the completion of a particular undertaking. See Rhode Island General Laws 7-12.1-102
  • percentages: means percentages by weights. See Rhode Island General Laws 4-2-3
  • Person: means individual, partnership, corporation, and association. See Rhode Island General Laws 4-2-3
  • person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
  • Person: means an individual, business corporation, nonprofit corporation, partnership, limited partnership, limited liability company, general cooperative association, limited cooperative association, unincorporated nonprofit association, statutory trust, business trust, common-law business trust, estate, trust, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Rhode Island General Laws 7-12.1-102
  • Pet: means any domesticated animal normally maintained in or near the household(s) of the owner(s). See Rhode Island General Laws 4-2-3
  • Poverty level: means students whose family income is at or below one hundred eighty-five percent (185%) of federal poverty guidelines. See Rhode Island General Laws 16-98-2
  • Principal office: means the principal executive office of a partnership or a foreign limited liability partnership, whether or not the office is located in this state. See Rhode Island General Laws 7-12.1-102
  • Product name: means the name of the commercial feed which identifies it as to kind, class, or specific use. See Rhode Island General Laws 4-2-3
  • Program: means furtherance of the advanced placement classes in the public schools and includes teacher training and increased student participation. See Rhode Island General Laws 16-98-2
  • Property: means all property, whether real, personal, or mixed or tangible or intangible, or any right or interest therein. See Rhode Island General Laws 7-12.1-102
  • Quorum: The number of legislators that must be present to do business.
  • real estate: may be construed to include lands, tenements, and hereditaments and rights thereto and interests therein. See Rhode Island General Laws 43-3-10
  • Recess: A temporary interruption of the legislative business.
  • Recipient student: means a student attending the community college of Rhode Island who qualifies to receive the Rhode Island promise scholarship pursuant to § 16-107-6;

    (7)  "Scholarship program" means the Rhode Island promise scholarship program that is established pursuant to § 16-107-3;

    (8)  "State" means the state of Rhode Island; and

    (9)  "Student with a disability" means any student otherwise eligible pursuant to § 16-107-6 who has a physical, developmental, or hidden disability or disabilities, as defined in § 42-87-1, that would create a hardship or other functional obstacles preventing participation in this program. See Rhode Island General Laws 16-107-4

  • Registered agent: means an agent of a limited liability partnership or foreign limited liability partnership which is authorized to receive service of any process, notice, or demand required or permitted by law to be served on the partnership. See Rhode Island General Laws 7-12.1-102
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • School district: means any public school district, school unit, area-vocational-technical school, charter school, or mayoral academy that composes a school district; the term also encompasses a single high school or multiple high schools within a school district where applicable. See Rhode Island General Laws 16-98-2
  • Southeast Asian: means individuals who identify with one or more ethnic groups originating from the countries in the Southeast Asian region, including Cambodia, the Philippines, Laos, Vietnam, and other Southeast Asian countries. See Rhode Island General Laws 16-108-2
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Rhode Island General Laws 7-12.1-102
  • Statute: A law passed by a legislature.
  • Teacher training entities: means institutions of higher education, intermediate units or organizations approved/certified by the College Board to train teachers to teach advanced placement courses. See Rhode Island General Laws 16-98-2
  • town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9
  • Transfer: includes :

    (i)  An assignment;

    (ii)  A conveyance;

    (iii)  A sale;

    (iv)  A lease;

    (v)  An encumbrance, including a mortgage or security interest;

    (vi)  A gift; and

    (vii)  A transfer by operation of law. See Rhode Island General Laws 7-12.1-102

  • Transferable interest: means the right, as initially owned by a person in the person's capacity as a partner, to receive distributions from a partnership, whether or not the person remains a partner or continues to own any part of the right. See Rhode Island General Laws 7-12.1-102
  • Transferee: means a person to which all or part of a transferable interest has been transferred, whether or not the transferor is a partner. See Rhode Island General Laws 7-12.1-102
  • United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
  • Virtual learning instruction: means providing academic courses to students via the Internet and/or the use of technology in providing instruction to students. See Rhode Island General Laws 16-98-2
