Terms Used In Rhode Island General Laws > Chapter 6-28 - Door-To-Door Sales
- Agreement: means a written contractual agreement between the merchant and the third-party delivery service. See Rhode Island General Laws 6-58-1
- Consumer Goods or Services: means goods or services purchased, leased, or rented primarily for personal, family, or household purposes, including courses of instruction or training regardless of the purpose for which they are taken. See Rhode Island General Laws 6-28-2
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Door-to-Door Sale: means a sale, lease, or rental of consumer goods or services with a purchase price of twenty-five dollars ($25. See Rhode Island General Laws 6-28-2
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Lien: A claim against real or personal property in satisfaction of a debt.
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
- Personal property: All property that is not real property.
- Place of Business: means the main or permanent branch office or local address of a seller. See Rhode Island General Laws 6-28-2
- Purchase Price: means the total price paid or to be paid for the consumer goods or services, including all interest and service charges. See Rhode Island General Laws 6-28-2
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
- Seller: means any person, partnership, corporation, or association engaged in the door-to-door sale of consumer goods or services. See Rhode Island General Laws 6-28-2
