A person who is injured by a sham legal process involving a violation of § 16-17-735 has the following civil remedies against the person who committed the violation or who caused the violation to be committed:
(1) actual damages;

- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Plaintiff: The person who files the complaint in a civil lawsuit.
(2) punitive damages;
(3) costs; and
(4) reasonable attorney’s fees. The amount of the recovery for the plaintiff is not determinative of the attorney’s fee.
