- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
No action shall be brought under the provisions of § 20-1-550 against a man or woman in the military or naval service who is beyond the seas, nor until after such man or woman in the military or naval service has returned from beyond the seas for a period of three months, unless such defendant consents to such proceeding.
