Terms Used In South Carolina Code 38-5-180
- Eligible surplus lines insurer: means a nonadmitted insurer with which a licensed broker, or a licensed producer as provided in § 38-45-10(8)(b)(ii), may place surplus lines insurance. See South Carolina Code 38-1-20
- Insurer: includes a corporation, fraternal organization, burial association, other association, partnership, society, order, individual, or aggregation of individuals engaging or proposing or attempting to engage as principals in any kind of insurance or surety business, including the exchanging of reciprocal or interinsurance contracts between individuals, partnerships, and corporations. See South Carolina Code 38-1-20
No insurer may operate from a location within South Carolina unless it is licensed as an insurer as provided in § 38-5-10, or permitted to operate as an approved reinsurer as provided in § 38-5-60, or qualified to operate as an eligible surplus lines insurer as provided in § 38-45-90.
