The court shall issue, upon motion of either party, a temporary order requiring the payment of child support pending an administrative or judicial determination of parentage if:
(1) the defendant has signed a verified voluntary acknowledgment of paternity which complies with the requirements of § 63-17-60(A)(4);
Terms Used In South Carolina Code 63-17-330
- Child: means a person under the age of eighteen. See South Carolina Code 63-1-40
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Parent: means biological parent, adoptive parents, step-parent, or person with legal custody. See South Carolina Code 63-1-40
(2) the defendant has been determined pursuant to law to be the parent; or
(3) there is other clear and convincing evidence that the defendant is the child’s parent.
