A petition for the termination of parental rights must set forth the:
(1) basis of the court‘s jurisdiction;
Terms Used In South Carolina Code 63-7-2540
- Child: means a person under the age of eighteen. See South Carolina Code 63-7-20
- Court: means the family court. See South Carolina Code 63-7-20
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Legal custody: means the right to the physical custody, care, and control of a child; the right to determine where the child shall live; the right and duty to provide protection, food, clothing, shelter, ordinary medical care, education, supervision, and discipline for a child and in an emergency to authorize surgery or other extraordinary care. See South Carolina Code 63-7-20
(2) name, sex, date, and place of birth of the child, if known;
(3) name and address of the petitioner and the petitioner’s relationship to the child;
(4) names, dates of birth, and addresses of the parents, if known;
(5) names and addresses of a:
(a) legal guardian of the child; or
(b) person or agency having legal custody of the child; and
(6) grounds on which termination of parental rights are sought and the underlying factual circumstances.
