Terms Used In South Carolina Code > Title 63 > Chapter 19 > Article 19 - Juvenile Records

• Arrest: Taking physical custody of a person by lawful authority.
• Child: means a person under the age of eighteen. See South Carolina Code 63-1-40
• Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
• Conviction: A judgement of guilt against a criminal defendant.
• Court: means the family court. See South Carolina Code 63-19-20
• Department: means the Department of Juvenile Justice. See South Carolina Code 63-19-20
• Judge: means the judge of the family court. See South Carolina Code 63-19-20
• Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
• juvenile: means a person less than eighteen years of age. See South Carolina Code 63-19-20
• Probable cause: A reasonable ground for belief that the offender violated a specific law.
• Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
• Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
• Status offense: means an offense which would not be a misdemeanor or felony if committed by an adult including, but not limited to, incorrigibility or beyond the control of parents, truancy, running away, playing or loitering in a billiard room, playing a pinball machine, or gaining admission to a theater by false identification.
