No distributor or manufacturer may knowingly possess, display, put out for play, sell, or otherwise furnish to any person or organization any deal of pulltabs:

(1) In which the winning pulltabs have not been completely and randomly distributed and mixed among all other pulltabs in the deal;

  • Person: includes natural persons, partnerships, associations, cooperative corporations, limited liability companies, and corporations. See South Dakota Codified Laws 2-14-2

(2) In which the location, or approximate location, of any of the winning pulltabs can be determined in advance of opening the pulltabs in any manner or by any device, including but not limited to, any pattern in the manufacture, assembly, or packaging of the pulltabs by the manufacturer, by any marking on the pulltabs or by the use of a light;

(3) Which does not conform in any respect to the requirements of this section, as to assembly, or packaging of pulltabs;

(4) In which each individual pulltab manufactured does not conspicuously set forth on it the name of the manufacturer or a label or trademark which identifies its manufacturer.
