An arrest is the taking of a person into custody so that he may be held to answer for the alleged commission of a public offense.
Terms Used In South Dakota Codified Laws 23A-3-1
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Arrest: Taking physical custody of a person by lawful authority.
- Person: includes natural persons, partnerships, associations, cooperative corporations, limited liability companies, and corporations. See South Dakota Codified Laws 2-14-2
