The person alleged to meet the criteria for boardordered commitment shall be represented by counsel. Such representation is not subject to waiver, and the person is entitled:

(1) To be present at the hearing;

Terms Used In South Dakota Codified Laws 27B-7-41

  • Continuance: Putting off of a hearing ot trial until a later time.
  • Person: includes natural persons, partnerships, associations, cooperative corporations, limited liability companies, and corporations. See South Dakota Codified Laws 2-14-2
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.

(2) To obtain a continuance in order to adequately prepare a case;

(3) To present documents and witnesses;

(4) To crossexamine witnesses; and

(5) To require testimony in person from the psychiatrist or psychologist who performed the evaluation required in 27B-7-28.
