The Board of Pharmacy may, in the manner provided by chapter 1-26, adopt a code of professional ethics for pharmacists in this state in the practice of their profession. In adopting such code, or any amendments thereafter, the board will consider the recommendations of the South Dakota Pharmacists Association and the vote of its members, provided however, that any such code so adopted shall at no time contain any provision that would in any way restrain, prohibit or attempt to regulate the rights of any pharmacist to be employed in any pharmacy holding a valid pharmacy permit. Violation of the code of professional ethics shall not be the basis for criminal prosecution unless otherwise declared unlawful.
