The board may take action authorized by § 36-9A-29 upon a satisfactory showing that the physical or mental condition of the license holder or applicant is determined by a competent medical examiner to jeopardize or endanger the health of those entrusted to the person‘s care. The board may demand an examination of the license holder or applicant by a competent medical examiner selected by the board at the license holder’s or applicant’s expense. If a license holder or applicant fails to submit to the examination, the failure constitutes immediate grounds for suspension of that person’s license or denial of licensure.
