Any party claimed against may assert any setoff or counterclaim that is within the jurisdiction of the department.
Terms Used In South Dakota Codified Laws 62-2-16
- Counterclaim: A claim that a defendant makes against a plaintiff.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
