Terms Used In Tennessee Code 27-8-103
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Property: includes both personal and real property. See Tennessee Code 1-3-105
- Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
It is not necessary that a levy shall be made on the defendant‘s property in order to entitle the defendant to the writ of certiorari and supersedeas.
