Terms Used In Tennessee Code 40-11-135
- Arrest: Taking physical custody of a person by lawful authority.
- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
The sheriff making the arrest under § 40-11-134 shall return the copy of the bail bond, with an endorsement of the sheriff’s action, in the same manner as the sheriff is required to return a capias.
