(a) It is an offense for any person to knowingly use a pesticide in a manner inconsistent with its labeling so as to cause harm to persons, animals, property or the environment.

Terms Used In Tennessee Code 43-8-116

  • Labeling: means all labels and other written, printed or graphic matter:
    (A) Upon the pesticide or any of its containers or wrappers. See Tennessee Code 43-8-102
  • Person: means any individual, partnership, association, corporation or organized group of persons whether incorporated or not. See Tennessee Code 43-8-102
  • Pesticide: means any substance or mixture of substances or chemical intended for defoliating or desiccating plants or for preventing, destroying, repelling, or mitigating any insects, rodents, fungi, bacteria, weeds or other forms of plant or animal life the commissioner shall declare to be a pest. See Tennessee Code 43-8-102
  • Property: includes both personal and real property. See Tennessee Code 1-3-105
(b) A violation of this section is a Class A misdemeanor punishable by fine or a term of imprisonment not to exceed thirty (30) days, or both.
(c) This section shall be construed to be supplemental to § 43-8-306.
