Terms Used In Tennessee Code 54-9-211

  • Contract: A legal written agreement that becomes binding when signed.
  • Department: means the department of transportation. See Tennessee Code 54-5-103
  • Highway: includes public bridges and may be held equivalent to the words "county way" "county road" or "state road". See Tennessee Code 1-3-105

  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
(b) On all county road and highway projects, the contractor shall be entitled to payments on account of the contractor’s contract in the same way and manner as payments are made to contractors performing state highway contracts, but no payments shall be made until the state engineer certifies that the work of the contractor, for which the contractor claims payment, has been satisfactorily performed in accordance with the contract.
