An officer shall detain a driver without a warrant, as provided in § 40-7-103, and bring the driver before a committing magistrate if the driver:

- accident: includes any collision or crash, regardless of the degree of care exercised by the drivers involved or whether it was the result of criminal conduct. See Tennessee Code 55-10-101
- Driver: means :
(A) For purposes of a conventionally operated vehicle, every person who drives or is in actual physical control of a vehicle. See Tennessee Code 55-8-101 - Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
