(a) This chapter shall not apply in any local government that has adopted regulations related to the siting of wind energy facilities in its jurisdiction on or before January 1, 2019.

Terms Used In Tennessee Code 65-17-102

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Local government: means any county, municipality, city, or other political subdivision of this state. See Tennessee Code 65-17-101
  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
(b) This chapter shall not apply to any wind energy facility located in this state that was constructed prior to April 24, 2018.
