(a) Any person who produces a fabricated or forged note or other evidence of indebtedness secured by a lien, and procures thereby a release under §§ 66-25-201 – 66-25-206, is guilty of forgery and punishable accordingly.

Terms Used In Tennessee Code 66-25-208

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
(b) If the true note, or other such evidence of indebtedness be produced, after its fraudulent or felonious obtainment, and the lien thereby procured to be so released, such person is guilty of a felony, with penalty as in case of forgery.
