Terms Used In Tennessee Code 68-11-503

  • Contract: A legal written agreement that becomes binding when signed.
  • Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
  • signed: includes a mark, the name being written near the mark and witnessed, or any other symbol or methodology executed or adopted by a party with intention to authenticate a writing or record, regardless of being witnessed. See Tennessee Code 1-3-105
(1) The contract provided for by §§ 68-11-501 and 68-11-502, when made by the county legislative body of any county, shall be embodied in a resolution and shall set forth in full the proposition made by any person offering to build and equip the hospital.
(2) The resolution shall be adopted by the majority vote of the members of the county legislative body at a regular meeting of the legislative body.
(b) The legislative body of any municipality shall adopt an ordinance embodying the contract with any person offering to build such hospital and the ordinance shall be duly passed, signed and attested as other ordinances made by the municipality.
(c) The contract so made by either a municipality or county, whether separately or jointly, shall be entered upon the minutes of the respective legislative bodies.
