Under the Tennessee Code, punishments for crimes depend on the classification. In the case of this section:| Class | Prison | Fine |

| class A misdemeanor | up to 11 months | up to $2,500 |
| class B misdemeanor | up to 6 months | up to $500 |
A first offense for a violation of this part is a Class B misdemeanor, punishable only by a fine of five hundred dollars ($500); and a second or subsequent such offense is a Class A misdemeanor.
