- Assets: means property, tangible or intangible, real or personal, belonging to or due a prisoner or former prisoner including income or payments to such prisoner from social security, worker's compensation, veteran's compensation, pension benefits, previously earned salary or wages, bonuses, annuities, retirement benefits, or from any other source whatsoever, but does not include any of the following:
(i) The homestead of the prisoner up to $50,000. See Michigan Laws 800.401aAttorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court. Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant. Correctional industries products: means all services provided, goods, wares, and merchandise manufactured or produced, wholly or in part, by inmates in any state correctional institution, but does not include either of the following:
(i) Products manufactured with inmate labor or services rendered with inmate labor in a private manufacturing or service enterprise established under section 7a. See Michigan Laws 800.322Correctional institution: means a state prison, prison facility, or other prison institution, correctional camp, community corrections center, correctional farm, state reformatory, or probation recovery camp, owned, operated, leased, supervised, or contracted for by this state. See Michigan Laws 800.322 Cost of care: means the cost to the department for providing transportation, room, board, clothing, security, medical, and other normal living expenses of prisoners, and the cost to the department for providing college-level classes or programs to prisoners, as determined by the department. See Michigan Laws 800.401a Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime. Department: means the department of corrections of this state. See Michigan Laws 800.401a Director: means the director of the department. See Michigan Laws 800.401a Escrow: Money given to a third party to be held for payment until certain conditions are met. Fiduciary: A trustee, executor, or administrator. Fund: means the maritime and port facility assistance fund created in section 7. See Michigan Laws 120.153 Grant program: means the maritime and port facility assistance grant program created in section 5. See Michigan Laws 120.153 Grantor: The person who establishes a trust and places property into it. grantor: may be construed as including every person from or by whom any estate in lands passes in or by any deed. See Michigan Laws 8.3e Green marine certification: means a certification issued or awarded by a nationally recognized maritime organization identified by the office that ranks or evaluates port facilities on various criteria, including, but not limited to, any of the following:
(i) Greenhouse gas and air pollutants. See Michigan Laws 120.153Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs. Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC Mortgage: The written agreement pledging property to a creditor as collateral for a loan. Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period. Office: means the maritime and port facility assistance office created in section 10s of 1951 PA 51, MCL 247. See Michigan Laws 120.153 person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l Port facility: means a commercial facility located alongside a navigable waterway used for commercial vessels and includes any of the following types of facilities:
(i) A seawall jetty, pier, wharf, or dock. See Michigan Laws 120.153Prisoner: means any person who is under the jurisdiction of the department and is either confined in any state correctional facility or is under the continuing jurisdiction of the department. See Michigan Laws 800.401a Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed. Quorum: The number of legislators that must be present to do business. shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c State correctional facility: means a facility or institution which houses a prisoner population under the jurisdiction of the department. See Michigan Laws 800.401a
