  • Advisory board: means each of the following:
    (i) The building officials advisory board described in section 1005. See Michigan Laws 339.6001
  • Alternative energy marine propulsion system: means an onboard propulsion system or detachable outboard propulsion system for a watercraft that is powered by an alternative energy system and that is the singular propulsion system for the watercraft. See Michigan Laws 207.822
  • Alternative energy system: means the small-scale generation or release of energy from 1 or any combination of the following types of energy systems:
  •     (i) A fuel cell energy system. See Michigan Laws 207.822
  • Alternative energy technology: means equipment, component parts, materials, electronic devices, testing equipment, and related systems that are specifically designed, specifically fabricated, and used primarily for 1 or more of the following:
  •     (i) The storage, generation, reformation, or distribution of clean fuels integrated within an alternative energy system or alternative energy vehicle, not including an anaerobic digester energy system or a hydroelectric energy system, for use within the alternative energy system or alternative energy vehicle. See Michigan Laws 207.822
  • Alternative energy technology business: means a business engaged solely in the research, development, or manufacturing of alternative energy technology. See Michigan Laws 207.822
  • Alternative energy vehicle: means a motor vehicle manufactured by an original equipment manufacturer that fully warrants and certifies that the motor vehicle meets federal motor vehicle safety standards for its class of vehicles as defined by the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 207.822
  • Alternative energy zone: means a renaissance zone designated as an alternative energy zone by the board of the Michigan strategic fund under section 8a of the Michigan renaissance zone act, 1996 PA 376, MCL 125. See Michigan Laws 207.822
  • alternative fueled vehicle: means a motor vehicle that can only be powered by a clean fuel energy system and can only be fueled by a clean fuel. See Michigan Laws 207.822
  • Anaerobic digester energy system: means a device or system of devices for optimizing the anaerobic digestion of biomass for the purpose of recovering biofuel for energy production. See Michigan Laws 207.822
  • Approved: means reviewed and found acceptable by the commission. See Michigan Laws 339.6001
  • Authority: means the Michigan next energy authority created under section 3. See Michigan Laws 207.822
  • Battery cell: means a closed electrochemical system that converts chemical energy from oxidation and reduction reactions directly into electric energy without combustion and without external fuel and consists of an anode, a cathode, and an electrolyte. See Michigan Laws 207.822
  • Battery cell energy system: means 1 or more battery cells and an inverter or other power conditioning unit used to perform 1 or more of the following functions:
  •     (i) Propel a motor vehicle or an alternative energy marine propulsion system. See Michigan Laws 207.822
  • biodiesel: means a diesel fuel substitute consisting of methyl or ethyl esters produced from the transesterification of animal or vegetable fats with methanol or ethanol. See Michigan Laws 207.822
  • biomass: means wood and paper products industries, food production and processing, trees and grasses grown specifically to be used as energy crops, and gaseous fuels produced from solid biomass, animal waste, municipal wastes, or landfills. See Michigan Laws 207.822
  • Biomass energy system: means a system that generates energy from a process using residues from wood and paper products industries, food production and processing, trees and grasses grown specifically to be used as energy crops, and gaseous fuels produced from solid biomass, animal waste, municipal wastes, or landfills. See Michigan Laws 207.822
  • Board: means the governing body of an authority under section 4. See Michigan Laws 207.822
  • Board: means , in each article of this act that is related to a specific occupation or occupations, the board that is created in that article and composed principally of members of the regulated occupation or occupations, or the commission or other agency that is defined in or designated as the board for purposes of that article. See Michigan Laws 339.5103
  • Building official: means a construction code enforcement person working as an inspector, or plan reviewer, or actively engaged in the administration and enforcement of adopted building, electrical, mechanical, or plumbing codes, or any combination of these codes. See Michigan Laws 339.6001
  • CHP energy system: means an integrated unit that generates power and either cools, heats, or controls humidity in a building or provides heating, drying, or chilling for an industrial process that includes and is limited to both of the following:
  •     (i) An absorption chiller, a desiccant dehumidifier, or heat recovery equipment. See Michigan Laws 207.822
  • Clean fuel: means 1 or more of the following:
  •     (i) Methane. See Michigan Laws 207.822
  • Clean fuel energy system: means a device that is designed and used solely for the purpose of generating power from a clean fuel. See Michigan Laws 207.822
  • Commission: means the state construction code commission created in section 3a of the Stille-DeRossett-Hale single state construction code act, 1972 PA 230, MCL 125. See Michigan Laws 339.6001
  • Competence: means a degree of expertise that enables an individual to engage in an occupation at a level that meets or exceeds minimal standards of acceptable practice for the occupation. See Michigan Laws 339.5103
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 339.5103
  • Department: means the department of management and budget. See Michigan Laws 207.822
  • electric vehicle: means a motor vehicle powered solely by a battery cell energy system. See Michigan Laws 207.822
  • Electricity storage device: means a device, including a capacitor, that directly stores electrical energy without conversion to an intermediary medium. See Michigan Laws 207.822
  • Electricity storage system: means 1 or more electricity storage devices and inverters or other power conditioning equipment. See Michigan Laws 207.822
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fire protection system: means that term as defined in the Michigan building code. See Michigan Laws 339.6001
  • Fire protection system plan reviewer: means an individual who meets the qualifications established under this article and is responsible for the review of fire protection system plans in accordance with the design and installation standards referenced by the Michigan building code. See Michigan Laws 339.6001
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Fuel cell: means an electrochemical device that uses an external fuel and continuously converts the energy released from the oxidation of fuel by oxygen directly into electricity without combustion and consists of an anode, a cathode, and an electrolyte. See Michigan Laws 207.822
  • Fuel cell energy system: means 1 or more fuel cells or fuel cell stacks and an inverter or other power conditioning unit. See Michigan Laws 207.822
  • fuel cell vehicle: means a motor vehicle powered solely by a fuel cell energy system. See Michigan Laws 207.822
  • Fuel processor: means a device that converts a fuel, including, but not limited to, methanol, natural gas, or gasoline, into a hydrogen rich gas, without combustion for use in a fuel cell. See Michigan Laws 207.822
  • General public: means each individual who resides in this state and is 18 years of age or older, other than an individual or the spouse of an individual who is licensed or registered in the occupation or who has a material financial interest in the occupation that is regulated by the specific article in which the term is used. See Michigan Laws 339.5105
  • hybrid electric vehicle: means a motor vehicle powered by an integrated propulsion system consisting of an electric motor and combustion engine. See Michigan Laws 207.822
  • hybrid vehicle: means a motor vehicle that can only be powered by an internal combustion engine and 1 or more alternative energy systems. See Michigan Laws 207.822
  • hydraulic hybrid vehicle: means a motor vehicle powered by a regenerative hydraulic drive system or powered by an internal combustion engine assisted by a regenerative hydraulic drive system. See Michigan Laws 207.822
  • Hydroelectric energy system: means a system related to the process of generating or putting into usable form the energy produced solely from flowing or falling water. See Michigan Laws 207.822
  • Inspector: means the individual who is responsible for the administration and enforcement of the construction of buildings, structures, or appurtenances under the state construction code. See Michigan Laws 339.6003
  • Michigan building code: means part 4 of the state construction code, R 408. See Michigan Laws 339.5107
  • microgrid: means the lines, wires, fuel lines and fuel reformers, and controls to connect 2 or more alternative energy systems. See Michigan Laws 207.822
  • Microturbine energy system: means a system that generates electricity, composed of a compressor, combustor, turbine, and generator, fueled solely by a clean fuel with a capacity of not more than 250 kilowatts. See Michigan Laws 207.822
  • Miniturbine energy system: means a system that generates electricity, composed of a compressor, combustor, turbine, and generator, fueled solely by a clean fuel with a capacity of not more than 2 megawatts. See Michigan Laws 207.822
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, partnership, corporation, limited liability company, association, governmental entity, or other legal entity. See Michigan Laws 207.822
  • Person: means an individual, sole proprietorship, partnership, association, limited liability company, corporation, or common law trust or a combination of those legal entities. See Michigan Laws 339.5107
  • Personal property: All property that is not real property.
  • Photovoltaic energy system: means a solar energy device composed of 1 or more photovoltaic cells or photovoltaic modules and an inverter or other power conditioning unit. See Michigan Laws 207.822
  • Plan reviewer: means an individual who is engaged in the practice of examining construction documents for the purpose of determining compliance with applicable codes. See Michigan Laws 339.6003
  • Provisional registration: means a building official, plan reviewer, or inspector who is registered subject to his or her completion of the amount of training, education, and experience required by the commission and the appropriate advisory board and described in section 1007(2). See Michigan Laws 339.6003
  • Quorum: The number of legislators that must be present to do business.
  • Regenerative hydraulic drive system: means a system that captures energy from nonparasitic vehicle sources or energy wasted by a vehicle's brakes or suspension to be released to directly assist vehicle propulsion or directly propel the vehicle. See Michigan Laws 207.822
  • Registered: means a building official, plan reviewer, inspector, fire protection system inspector, or fire protection system plan reviewer who is registered under this article. See Michigan Laws 339.6003
  • Renewable fuels: means 1 or more of the following:
  •     (i) Biodiesel or biodiesel blends containing at least 20% biodiesel. See Michigan Laws 207.822
  • Rule: means a rule promulgated under the administrative procedures act of 1969. See Michigan Laws 339.5107
  • seal: shall be construed to include any of the following:
  •     (a) The impression of the seal on the paper alone. See Michigan Laws 8.3n
  • Small-scale: means 1 or more of the following:
  •     (i) A single energy system with a generating capacity of not more than 2 megawatts or an integrated energy system with a generating capacity of not more than 10 megawatts. See Michigan Laws 207.822
  • solar vehicle: means a motor vehicle powered solely by a photovoltaic energy system. See Michigan Laws 207.822
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • State construction code: means the rules promulgated by the state construction code commission under section 4 of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5107
  • Stille-DeRossett-Hale single state construction code act: means 1972 PA 230, MCL 125. See Michigan Laws 339.5107
  • Stirling cycle energy system: means a closed-cycle, regenerative heat engine that is fueled solely by a clean fuel and uses an external combustion process, heat exchangers, pistons, a regenerator, and a confined working gas, such as hydrogen or helium, to convert heat into mechanical energy. See Michigan Laws 207.822
  • Thermoelectric energy system: means a system that generates energy by converting thermal energy into electrical energy using direct heat from a clean fuel energy system or waste heat from any source. See Michigan Laws 207.822
  • Wind energy system: means an integrated unit consisting of a wind turbine composed of a rotor, an electrical generator, a control system, an inverter or other power conditioning unit, and a tower, which uses moving air to produce power. See Michigan Laws 207.822
