  • Accommodations: means the room or other space provided to transient guests for dwelling, lodging, or sleeping, including furnishings and other accessories, in a facility that is not a campground, hospital, nursing home, emergency shelter, or community mental health or community substance abuse treatment facility. See Michigan Laws 207.623
  • Accommodations: means the room or other space provided for sleeping, including furnishings and other accessories in the room but not including the provision of food, beverages, telephone services, television or movie services, or other similar services, in a facility that is not a hospital, nursing home, emergency shelter, community mental health or community substance abuse treatment facility, or campground. See Michigan Laws 207.751
  • Adjusted household income: means that term as defined in R 125. See Michigan Laws 207.902

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.

  • Affiliated business: means a business that is at least 50% owned and controlled, directly or indirectly, by an associated business. See Michigan Laws 207.803
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Age: means chronological age except as otherwise provided by law. See Michigan Laws 37.2103
  • Air conditioning: means the process of treating air to meet the requirements of a conditioned space by controlling, either simultaneously or individually, the air's temperature, humidity, cleanness, and distribution. See Michigan Laws 339.5801
  • Airport parking facility: means an area, space, garage, parking structure, or other facility upon or in which motor vehicles are parked, stored, or housed for a consideration and that is located within the boundaries or within 5 miles of the boundaries of a regional airport facility. See Michigan Laws 207.372
  • Alcohol: means fuel grade ethanol or a mixture of fuel grade ethanol and another product. See Michigan Laws 207.1002
  • Allegation: something that someone says happened.
  • Alternative fuel: means that term as defined in section 151 of the motor fuel tax act, 2000 PA 403, MCL 207. See Michigan Laws 207.211
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • Appraisal: means an opinion, conclusion, or analysis relating to the value of real property but does not include any of the following:
    (i) A market analysis performed by a person that is licensed under article 25 solely for the purpose of assisting a customer or potential customer in determining the potential sale, purchase, or listing price of real property or the rental rate of real property as long as a fee or any other valuable consideration is not charged for that analysis.   • Appraisal: means that term as defined in section 2601. See Michigan Laws 339.2661
  • Appraisal management company: means a person that provides appraisal management services. See Michigan Laws 339.2661
  • Appraisal management services: means to perform any of the following functions for a client or clients:
  •     (i) Recruiting, selecting, and retaining appraisers. See Michigan Laws 339.2661
  • Appraiser: means an individual who is engaged in or offering to engage in the development and communication of an appraisal. See Michigan Laws 339.2601
  • Appraiser: means that term as defined in section 2601. See Michigan Laws 339.2661
  • Appraiser panel: means a network, list, or roster of licensed or certified appraisers approved by an appraisal management company to perform appraisals as independent contractors for the appraisal management company. See Michigan Laws 339.2661
  • Apprentice electrician: means an individual other than an electrical contractor, master electrician, or electrical journeyman, who is engaged in learning about and assisting in the installation or alteration of electrical wiring and equipment under the direct personal supervision of an electrical journeyman or master electrician. See Michigan Laws 339.5701
  • Apprentice plumber: means an individual who is registered under this article as an apprentice. See Michigan Laws 339.6101
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved apprenticeship program: means a training program for boiler operators or stationary engineers that is certified by or meets the standards of the Office of Apprenticeship in the United States Department of Labor and is approved by the board. See Michigan Laws 339.5901
  • AQB criteria: means all of the following, if applicable:
  •     (i) The criteria established by the appraiser qualifications board of the appraisal foundation and in effect on the effective date of the amendatory act that added subparagraph (ii). See Michigan Laws 339.2601
  • Architect: means a person who, by reason of knowledge of mathematics, the physical sciences, and the principles of architectural design, acquired by professional education and practical experience, is qualified to engage in the practice of architecture. See Michigan Laws 339.2001
  • Armed forces: means the United States Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard or other military force designated by Congress as a part of the Armed Forces of the United States, including the reserve components. See Michigan Laws 339.5103
  • Arrest: Taking physical custody of a person by lawful authority.
  • Artificial brine: means mineralized water formed by dissolving rock salt or other readily soluble rocks or minerals. See Michigan Laws 324.62501
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • associate real estate broker: means an individual who meets the requirements for licensure as a real estate broker under this article and who is licensed as an associate real estate broker under section 2505 to provide real estate brokerage services as an employee or independent contractor of a real estate broker. See Michigan Laws 339.2501
  • Associated auxiliaries: means equipment that is required in the operation of a boiler that includes, but is not limited to, pumps, regulators, feedwater heaters, superheaters, de-superheaters, economizers, air preheaters, draft fans, combustion and pollution control equipment, and prime movers. See Michigan Laws 339.5901
  • Associated business: means a business that owns at least 50% of and controls, directly or indirectly, an authorized business. See Michigan Laws 207.803
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attainable housing property: means that portion of real property not occupied by an owner of that real property of not more than 4 units that is classified as residential real property under section 34c of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.902
  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means the Michigan economic growth authority created under section 4. See Michigan Laws 207.803
  • Authorized business: means 1 of the following:
  •     (i) A single eligible business with a unique federal employer identification number that has met the requirements of section 8 and with which the authority has entered into a written agreement for a tax credit under section 9. See Michigan Laws 207.803
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Blended motor fuel: means a mixture of motor fuel and another liquid, other than a de minimis amount of a product including, but not limited to, carburetor detergent or oxidation inhibitor, that can be used as motor fuel in a motor vehicle. See Michigan Laws 207.1002
  • Blender: means and includes any person who produces blended motor fuel outside of the bulk transfer/terminal system. See Michigan Laws 207.1002
  • blending: means the mixing of 1 or more petroleum products, with or without another product, regardless of the original character of the product blended, if the product obtained by the blending is capable of use in the generation of power for the propulsion of a motor vehicle, an airplane, or a marine vessel. See Michigan Laws 207.1002
  • Blendstock: means and includes any petroleum product component of motor fuel, such as naphtha, reformate, or toluene; or any oxygenate that can be blended for use in a motor fuel. See Michigan Laws 207.1002
  • Board: means the electrical administrative board described in section 705. See Michigan Laws 339.5701
  • Board: means the board of mechanical rules described in section 805. See Michigan Laws 339.5801
  • Board: means the board of boiler rules described in section 905. See Michigan Laws 339.5901
  • Board: means the state plumbing board described in section 1105. See Michigan Laws 339.6101
  • Board: means , in each article of this act that is related to a specific occupation or occupations, the board that is created in that article and composed principally of members of the regulated occupation or occupations, or the commission or other agency that is defined in or designated as the board for purposes of that article.   • Board files: means the records, memoranda, opinions, minutes, and similar written materials that were formerly in the physical possession and control of a board abolished by this act and the records, memoranda, opinions, minutes, and similar written materials of a board created under this act.   • Boiler: means a closed vessel in which water is heated, steam is generated, or steam is superheated, or a combination of those actions occurs, under pressure or vacuum by the application of heat from combustible fuels, electricity, or nuclear energy. See Michigan Laws 339.5901
  • Building official: means a construction code enforcement person working as an inspector, or plan reviewer, or actively engaged in the administration and enforcement of adopted building, electrical, mechanical, or plumbing codes, or any combination of these codes. See Michigan Laws 339.6001
  • Building sewer: means that part of the drainage system that extends from the end of the building drain and conveys its discharge to a public sewer, private sewer, individual sewage disposal system, or other point of disposal. See Michigan Laws 339.6101
  • Bulk end user: means a person who receives into the person's own storage facilities by transport truck or tank wagon motor fuel for the person's own consumption. See Michigan Laws 207.1002
  • Bulk plant: means a motor fuel storage and distribution facility that is not a terminal and from which motor fuel may be withdrawn by a tank wagon, a transport truck, or a marine vessel. See Michigan Laws 207.1002
  • Bulk transfer: means a transfer of motor fuel from 1 location to another by pipeline tender or marine delivery within the bulk transfer/terminal system, including, but not limited to, all of the following transfers:
  •     (i) A marine vessel movement of motor fuel from a refinery or terminal to a terminal. See Michigan Laws 207.1002
  • Business: means proprietorship, joint venture, partnership, limited liability partnership, trust, business trust, syndicate, association, joint stock company, corporation, cooperative, limited liability company, or any other organization. See Michigan Laws 207.803
  • Business entity: means a person described in section 105(5)(b) or (c), except a sole proprietorship or general partnership. See Michigan Laws 339.1801
  • Business entity: means a person described in section 105(5)(b) or (c), except a sole proprietorship. See Michigan Laws 339.2501
  • Carrier: means an operator of a pipeline or marine vessel engaged in the business of transporting motor fuel above the terminal rack. See Michigan Laws 207.1002
  • casino: means a casino or a parking lot, hotel, motel, or retail store owned or operated by a casino, an affiliate, or an affiliated company, regulated by this state pursuant to the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 207.842

  • Certified general real estate appraiser: means an individual who is licensed under section 2610 to appraise all types of real property, including nonresidential real property involving federally related transactions and real estate related financial transactions. See Michigan Laws 339.2601
  • Certified residential real estate appraiser: means an individual who is licensed under section 2610 to appraise all types of residential real property involving real estate related financial transactions and federally related transactions as authorized by the regulations of a federal financial institution regulatory agency and resolution trust corporation as well as any nonresidential, nonfederally related transaction for which the individual is qualified.   • Charitable organization: means a not-for-profit tax-exempt religious, educational, or humane organization. See Michigan Laws 339.5103
  • Chief executive officer: means for a county the county executive of a county or, if the county does not have an elected county executive, the chairperson of the county board of commissioners and for a city, the mayor. See Michigan Laws 207.751
  • Citation: means that term as described in section 537. See Michigan Laws 339.5103
  • citation: means a complaint or notice upon which a police officer shall record an occurrence involving 1 or more vehicle law violations by the person cited. See Michigan Laws 257.727c
  • Classroom course: means an educational course of instruction that is provided at either of the following:
  •     (i) A physical location where instruction is offered and students and an instructor are present. See Michigan Laws 339.2501
  • Client: means a person that contracts with, or otherwise enters into an agreement with, an appraisal management company for the performance of real estate appraisal services. See Michigan Laws 339.2661
  • Clock hour: means either of the following:
  •     (i) For a classroom course at a location described in subdivision (c)(i), a period of 50 to 60 minutes of actual classroom instruction, not including outside assignments and reading. See Michigan Laws 339.2501
  • Commercial housing facilities exemption certificate: means a certificate issued pursuant to sections 3, 4, and 5. See Michigan Laws 207.601
  • Commercial motor vehicle: means a motor vehicle licensed as a qualified commercial motor vehicle under the motor carrier fuel tax act, 1980 PA 119, MCL 207. See Michigan Laws 207.1002
  • Commercial property: means land improvements classified by law for general ad valorem tax purposes as real property including real property assessable as personal property pursuant to sections 8(d) and 14(6) of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.842

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Complaint: means an oral or written grievance. See Michigan Laws 339.5103
  • Completed application: means an application that is complete on its face and submitted with any applicable licensing or permit fees and any other information, records, approval, security, or similar item required by law or rule from a local unit of government, a federal agency, or a private entity but not from another department or agency of this state. See Michigan Laws 339.5103
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Consumer price index: means United States consumer price index for all urban consumers as defined and reported by the United States Department of Labor, Bureau of Labor Statistics. See Michigan Laws 207.1002
  • Contested case hearing: means a hearing under chapter 4 of the administrative procedures act of 1969, MCL 24. See Michigan Laws 339.5103
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Controlling interest: means more than 80% of the total value of all classes of stock of a corporation; more than 80% of the total interest in capital and profits of a partnership, association, limited liability company, or other unincorporated form of doing business; or more than 80% of the beneficial interest in a trust. See Michigan Laws 207.522
  • Controlling person: means any of the following:
  •     (i) An owner, officer, or director of a corporation, partnership, or other business entity that offers or applies to offer appraisal management services in this state. See Michigan Laws 339.2661
  • Convention facility: means 1 or more facilities owned or leased by a local governmental unit or metropolitan authority created under the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.623
  • Convention facility: means a convention exhibition facility, including meeting rooms and necessary sites, related parking lots or structures, and appurtenant properties and facilities, if the facility itself contains not less than 50,000 square feet of exhibition space and if the eligible municipality is a county, the facility is located within the boundaries of the most populous city in the county.   • Convention hotel: means a facility used in the business of providing accommodations that has more than 80 rooms for providing accommodations to transient guests and that complies with all of the following:
  •     (i) Is located within a county having a population according to the most recent decennial census of 700,000 or more. See Michigan Laws 207.623
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooling: means air conditioning as defined in subdivision (a). See Michigan Laws 339.5801
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Decedent: A deceased person.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the department of treasury. See Michigan Laws 206.1083

  •     (i) A determinable physical or mental characteristic of an individual, which may result from disease, injury, congenital condition of birth, or functional disorder, if the characteristic:
        (A) For purposes of article 2, substantially limits 1 or more of the major life activities of that individual and is unrelated to the individual's ability to perform the duties of a particular job or position or substantially limits 1 or more of the major life activities of that individual and is unrelated to the individual's qualifications for employment or promotion.   • Disability: means an infirmity that prevents a board member from performing a duty assigned to the board member. See Michigan Laws 339.5103

  • Disposal well: means a well drilled or converted for subsurface disposal of waste products or processed brine and its related surface facilities. See Michigan Laws 324.62501
  • Distressed business: means a business that meets all of the following as verified by the Michigan economic growth authority:
  •     (i) Four years immediately preceding the application to the authority under this act, the business had 150 or more full-time jobs in this state. See Michigan Laws 207.803
  • district: means an area not less than 3 acres in size of a qualified local governmental unit established as provided in section 3. See Michigan Laws 207.842
  • district: means an area in a qualified local governmental unit established as provided in section 3 in which attainable housing property is or will be located. See Michigan Laws 207.902
  • district: means an area not less than 1 acre in size of a qualified local governmental unit established as provided in section 3. See Michigan Laws 207.952
  • Docket: A log containing brief entries of court proceedings.

  • Ductwork: means the air distribution arrangement for supply, return, and exhaust in air conditioning systems and in nonair conditioning systems, the materials and methods of which are specified in the Michigan mechanical code, or an equivalent nationally recognized model mechanical code.   • Dyed diesel fuel: means diesel fuel that is dyed in accordance with internal revenue service rules or pursuant to any other internal revenue service requirements, including any invisible marker requirements. See Michigan Laws 207.1002
  • educational institution: means a public or private institution or a separate school or department of a public or private institution, includes an academy, college, elementary or secondary school, extension course, kindergarten, nursery, school system, school district, or university, and a business, nursing, professional, secretarial, technical, or vocational school, and includes an agent of an educational institution. See Michigan Laws 37.1401
  • Electric sign: means fixed, stationary, or portable self-contained, electrically illuminated equipment that has words or symbols designed to convey information or attract attention. See Michigan Laws 339.5701
  • Electrical contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining electrical wiring. See Michigan Laws 339.5701
  • Electrical journeyman: means an individual other than an electrical contractor who, as his or her principal occupation, is engaged in the practical installation or alteration of electrical wiring. See Michigan Laws 339.5701
  • Electrical wiring: means all wiring, generating equipment, fixtures, appliances, devices, and appurtenances in connection with the generation, distribution, and utilization of electrical energy, in or on a building, residence, structure, or properties, regardless of whether or not the electrical wiring is energized at the time of installation. See Michigan Laws 339.5701
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Eligible business: means a distressed business or business that proposes to maintain retained jobs after December 31, 1999 or to create qualified new jobs in this state after April 18, 1995 in manufacturing, mining, research and development, wholesale and trade, film and digital media production, or office operations or a business that is a qualified high-technology business or a business that is a tourism attraction facility or a qualified lodging facility.   • Eligible county: means a county with a population of 1,500,000 or more persons that adopts or has adopted a charter under 1966 PA 293, MCL 45. See Michigan Laws 207.751
  • Eligible municipality: means any of the following:
  •     (i) An eligible county that intends to impose a tax under this act for purposes related to a stadium as defined under subdivision (i)(i). See Michigan Laws 207.751
  • Eligible purchaser: means a person who has been authorized by the department under section 75 to make an election under section 74. See Michigan Laws 207.1002
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Employer: means a person that has 1 or more employees, and includes an agent of that person. See Michigan Laws 37.2201
  • employment: means the relationship between a real estate broker and an associate real estate broker or a real estate salesperson which may include an independent contractor relationship. See Michigan Laws 339.2501
  • Employment agency: means a person regularly undertaking with or without compensation to procure, refer, recruit, or place an employee for an employer or to procure, refer, recruit, or place for an employer or person the opportunity to work for an employer and includes an agent of that person. See Michigan Laws 37.2201
  • Enforcing agency: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Excluded liquid: means that term as defined in 26 C. See Michigan Laws 207.1002
  • Executor: A male person named in a will to carry out the decedent
  • experience: includes any relevant experience acquired while serving in the armed forces by an individual who was separated from that service if all of the following are met:
  •     (a) The applicant provides to the department a form DD214, a form DD215, or any other form that is satisfactory to the department that demonstrates that he or she was separated from that service, with an honorable character of service or under honorable conditions (general) character of service.   • Exploratory purposes: means test well drilling for the specific purpose of discovering or outlining an orebody or mineable mineral resource. See Michigan Laws 324.62501
  • Export: means to obtain motor fuel in this state for sale or other distribution outside of this state. See Michigan Laws 207.1002
  • Exporter: means a person who exports motor fuel. See Michigan Laws 207.1002
  • External inspection: means an inspection that does not involve examination of the internal surfaces of the pressure parts of the boiler. See Michigan Laws 339.5901
  • Facility: means a site or sites within this state in which an authorized business or subsidiary business maintains retained jobs or creates qualified new jobs. See Michigan Laws 207.803
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Federal financial institution regulatory agency: means the board of governors of the federal reserve system, the federal deposit insurance corporation, the office of the comptroller of the currency, the office of thrift supervision, or the national credit union administration.   • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C.   • Federally regulated appraisal management company: means an appraisal management company that is owned and controlled by an insured depository institution, as that term is defined in 12 USC 1813, and is regulated by the Office of the Comptroller of the Currency, the Board of Governors of the Federal Reserve System, or the Federal Deposit Insurance Corporation.   • Federally related transaction: means any real estate related financial transaction that a federal financial institution regulatory agency engages in, contracts for, or regulates and that requires the services of an appraiser under any of the following:
  •     (i) 12 C. See Michigan Laws 339.2601
  • Ferrous product: means a commercially salable ferrous mineral in its final marketable form or state. See Michigan Laws 324.63101
  • Fiduciary: A trustee, executor, or administrator.
  • Film and digital media production: means the development, preproduction, production, postproduction, and distribution of single media or multimedia entertainment content for distribution or exhibition to the general public in 2 or more states by any means and media in any digital media format, film, or video tape, including, but not limited to, a motion picture, a documentary, a television series, a television miniseries, a television special, interstitial television programming, long-form television, interactive television, music videos, interactive games, video games, internet programming, an internet video, a sound recording, a video, digital animation, or an interactive website. See Michigan Laws 207.803
  • Fire alarm contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining wiring, devices, appliances, or equipment of a fire alarm system. See Michigan Laws 339.5701
  • Fire alarm specialty apprentice technician: means an individual other than a fire alarm contractor or a fire alarm specialty technician who is engaged in learning about and assisting in the installation or alteration of fire alarm system wiring and equipment under the direct personal supervision of a fire alarm specialty technician. See Michigan Laws 339.5701
  • Fire alarm specialty licensure: means licensure as a fire alarm contractor or a fire alarm specialty or apprentice technician. See Michigan Laws 339.5701
  • Fire alarm specialty technician: means an individual other than a fire alarm contractor who, as his or her principal occupation, is engaged in the design and practical installation or alteration of fire alarm systems. See Michigan Laws 339.5701
  • Fire alarm system: means a system that is designed to detect and annunciate the presence of fire, or by-products of fire, installed in a building or structure. See Michigan Laws 339.5701
  • Fire protection system: means that term as defined in the Michigan building code. See Michigan Laws 339.6001
  • Fire protection system inspector: means an individual who meets the qualifications established under this article and is responsible for the inspection of fire protection systems in accordance with the design and installation standards referenced by the Michigan building code. See Michigan Laws 339.6001
  • Fire protection system plan reviewer: means an individual who meets the qualifications established under this article and is responsible for the review of fire protection system plans in accordance with the design and installation standards referenced by the Michigan building code. See Michigan Laws 339.6001
  • Firm: means a sole proprietorship, partnership, corporation, or limited liability company through which a person licensed under this article offers or provides a service to the public. See Michigan Laws 339.2001
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Formal complaint: means a document that states the charges of each alleged violation and is prepared by the department or the department of attorney general after a complaint is received by the department. See Michigan Laws 339.5105
  • Former act: means former 1956 PA 217; former 1984 PA 192; former 1986 PA 54; former 2002 PA 733; or former 1965 PA 290, as applicable. See Michigan Laws 339.5105
  • Fraud: Intentional deception resulting in injury to another.
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Fuel feedstock user: means a person who receives motor fuel for the person's own use in the manufacture or production of any substance other than motor fuel. See Michigan Laws 207.1003
  • Fuel grade ethanol: means the American Society for Testing and Materials standard in effect on April 1, 2001 as the D-4806 specification for denatured fuel grade ethanol for blending with gasoline. See Michigan Laws 207.1003
  • Fuel transportation vehicle: means a vehicle designed or used to transport motor fuel on the public roads or highways. See Michigan Laws 207.1003
  • Full-time job: means a job performed by an individual for 35 hours or more each week and whose income and Social Security taxes are withheld by 1 or more of the following:
  •     (i) An authorized business. See Michigan Laws 207.803
  • Fund: means the Michigan World War II Legacy Memorial fund created in section 5. See Michigan Laws 206.1083
  • Fund: means the airport parking fund created in section 6. See Michigan Laws 207.372
  • Fund: means the mineral well regulatory fund created in section 62509b. See Michigan Laws 324.62501
  • Fund: means the nonferrous metallic mineral surveillance fund created in section 63217. See Michigan Laws 324.63201
  • Funeral establishment: means a place of business used in the care and preparation for burial or transportation of a dead human body or a place where an individual represents that he or she is engaged in the profession of undertaking or the practice of mortuary science. See Michigan Laws 339.1801
  • Gallon: means a unit of liquid measure as customarily used in the United States containing 231 cubic inches, or 4 quarts, or its metric equivalent expressed in liters. See Michigan Laws 207.1003
  • Gallon equivalent: means that term as defined in section 151 of the motor fuel tax act, 2000 PA 403, MCL 207. See Michigan Laws 207.211
  • Gasohol: means a blended motor fuel composed of gasoline and fuel grade ethanol. See Michigan Laws 207.1003
  • Gasoline: means gasoline, alcohol, gasohol, casing head or natural gasoline, benzol, benzine, naphtha, and any blendstock additive, or other product including methanol that is sold for blending with gasoline or for use on the road other than products typically sold in containers of less than 5 gallons. See Michigan Laws 207.1003
  • Gender identity or expression: means having or being perceived as having a gender-related self-identity or expression whether or not associated with an individual's assigned sex at birth. See Michigan Laws 37.2103
  • General public: means each individual who resides in this state and is 18 years of age or older, other than an individual or the spouse of an individual who is licensed or registered in the occupation or who has a material financial interest in the occupation that is regulated by the specific article in which the term is used. See Michigan Laws 339.5105
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Good moral character: means that term as defined in, and determined under, 1974 PA 381, MCL 338. See Michigan Laws 339.5105
  • Governmental subdivision: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105
  • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • grantee: may be construed as including every person to whom any such interest or estate passes in like manner. See Michigan Laws 8.3e
  • Grantor: The person who establishes a trust and places property into it.

  • Gross gallons: means the total measured product, exclusive of any temperature or pressure adjustments, considerations, or deductions, in gallons. See Michigan Laws 207.1003
  • Gross receipts: means that term as defined in former section 7 of 1975 PA 228, or section 111 of the Michigan business tax act, 2007 PA 36, MCL 208. See Michigan Laws 207.751
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Heating surface: means the heating surface determined by the boiler manufacturer and recorded in the manufacturer's data report or by rules established by the board for a boiler if the manufacturer's data report is not available or the boiler is not stamped with its heating surface. See Michigan Laws 339.5901
  • High-technology activity: means 1 or more of the following:
  •     (i) Advanced computing, which is any technology used in the design and development of any of the following:
        (A) Computer hardware and software. See Michigan Laws 207.803
  • Holder of a license for the practice of mortuary science: means an individual who satisfactorily completes a course in mortuary science, passes an examination required under this article, serves the required resident training, and is issued a license for the practice of mortuary science. See Michigan Laws 339.1801
  • Housing accommodation: includes improved or unimproved real property, or a part thereof, which is used or occupied, or is intended, arranged, or designed to be used or occupied, as the home or residence of 1 or more persons. See Michigan Laws 37.1501
  • HVAC: means the application of equipment and systems to provide air conditioning for occupants of buildings and structures. See Michigan Laws 339.5801
  • Immediate family: means a spouse, parent, child, or sibling. See Michigan Laws 37.1501
  • Implement of husbandry: means a farm tractor, a vehicle designed to be drawn or pulled by a farm tractor or animal, a vehicle that directly harvests farm products, or a vehicle that directly applies fertilizer, spray, or seeds to a farm field. See Michigan Laws 207.1003
  • Import: means to bring motor fuel into this state by motor vehicle, marine vessel, pipeline, or any other means. See Michigan Laws 207.1003
  • Import verification number: means the number assigned by the department to an individual delivery of motor fuel by a transport truck, tank wagon, marine vessel, or rail car in response to a request for a number from an importer or transporter carrying motor fuel into this state for the account of an importer. See Michigan Laws 207.1003
  • Importer: means a person who imports motor fuel into this state. See Michigan Laws 207.1003
  • In this state: means the area within the borders of this state, including all territories within the borders owned by, held in trust by, or added to the United States of America. See Michigan Laws 207.1003
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q
  • Income-qualified household: means an individual, couple, family, or group of unrelated individuals whose adjusted household income is 120% or less of the countywide area median income as posted annually by the Michigan state housing development authority on its website. See Michigan Laws 207.902
  • Income-qualified household: means an individual, couple, family, or group of unrelated individuals whose adjusted household income is 120% or less of the countywide area median income as posted annually by the Michigan state housing development authority on its website.   • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Inflation rate: means the annual percentage change in the consumer price index, as determined by the department, comparing the 2 most recent October 1 through September 30 periods that are immediately preceding the effective date of the rate prescribed under section 8(1)(c), converted to decimals.   • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inspector: means the individual who is responsible for the administration and enforcement of the construction of buildings, structures, or appurtenances under the state construction code. See Michigan Laws 339.6003
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Jobsite: means the immediate work area within the property lines of a single construction project, alteration project, or maintenance project where electrical construction or alteration of electrical wiring is in progress. See Michigan Laws 339.5703
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Journey plumber: means an individual, other than a plumbing contractor or master plumber, who is qualified to engage in the practical installation of plumbing and who is licensed as a journey plumber. See Michigan Laws 339.6101
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Kerosene: means all grades of kerosene, including, but not limited to, the 2 grades of kerosene, No. See Michigan Laws 207.1004
  • Labor organization: includes :
  •     (i) An organization of any kind, or an agency or employee representation committee, group, association, or plan, in which employees participate and that exists for the purpose, in whole or in part, of dealing with employers concerning grievances, labor disputes, wages, rates of pay, hours, or other terms or conditions of employment. See Michigan Laws 37.2201
  • Landscape architect: means a person qualified to engage in the practice of landscape architecture as provided in this article. See Michigan Laws 339.2201
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Leaded racing fuel: is a fuel other than diesel fuel that is leaded and at least 100 octane and is used in vehicles on a racetrack. See Michigan Laws 207.1004
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legacy: A gift of property made by will.
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: includes the whole or part of a governmental permit, certificate, approval, registration, charter, or similar form of permission required under a specific article of this act. See Michigan Laws 339.5105
  • License cycle: means the term of a license issued under this article. See Michigan Laws 339.2501
  • Licensee: means a person that is issued a license under this act. See Michigan Laws 339.5105
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Limitation: means a condition, stricture, constraint, restriction, or probation attached to a license that relates to the scope of practice of that occupation by the licensee. See Michigan Laws 339.5105
  • Limited heating service: means the servicing of gas-designed sectional boilers that have inputs of not more than 1 million British thermal units, utilizing a combustion safeguard designed to shut off the main gas supply 10 or more seconds after pilot flame failure, and all other gas-fired or solid-fuel equipment and systems limited to input ratings of less than 400,000 British thermal units per unit; or oil-fired equipment and systems designed for the use of number 1 or number 2 fuel oil, that has a maximum firing rate of less than 5 gallons per hour per unit; or electrical furnaces and electric boilers that use the same kilowatts that are equivalent to the fossil fuel British thermal units generated.   • Limited real estate appraiser: means an individual who meets the AQB criteria for appraiser trainee and is licensed under section 2610 to perform appraisals of those properties that the state certified supervisory appraiser is permitted and competent to appraise. See Michigan Laws 339.2601
  • Liquid: means any substance that is liquid in excess of 60 degrees Fahrenheit and a pressure of 14. See Michigan Laws 207.1004
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Local governmental unit: means a city, village, or township. See Michigan Laws 207.601
  • Local governmental unit: means a county, township, city, village, or a metropolitan authority formed under the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.623
  • Low pressure boiler: means a steam boiler operated at pressures that do not exceed 15 p. See Michigan Laws 339.5903
  • Master electrician: means an individual who has the necessary qualifications, training, experience, and technical knowledge to supervise the installation of electrical wiring and equipment in accordance with the standard rules and regulations governing that work. See Michigan Laws 339.5703
  • Master plumber: means an individual who possesses the necessary skills and qualifications to plan and supervise the installation of plumbing and who is licensed as a master plumber. See Michigan Laws 339.6103
  • Metallic product: means a commercially salable mineral produced primarily for its nonferrous metallic mineral content in its final marketable form or state. See Michigan Laws 324.63201
  • Michigan building code: means part 4 of the state construction code, R 408. See Michigan Laws 339.5107
  • Michigan electrical code: means part 8 of the state construction code, R 408. See Michigan Laws 339.5107
  • Michigan mechanical code: means part 9A of the state construction code, R 408. See Michigan Laws 339.5107
  • Michigan plumbing code: means part 7 of the state construction code, R 408. See Michigan Laws 339.5107
  • mineral: means ferrous ore or material mined for its ferrous content. See Michigan Laws 324.63101
  • Mineral well: means any well subject to this part. See Michigan Laws 324.62501
  • Mining area: means an area of land from which earth material is removed in connection with nonferrous metallic mineral mining, the lands on which material from that mining is stored or deposited, the lands on which beneficiating or treatment plants and auxiliary facilities are located, the lands on which the water reservoirs used in the nonferrous metallic mineral mining process are located, and auxiliary lands that are used in connection with the mining.   • Mining operation: means a ferrous mineral mining operation. See Michigan Laws 324.63101
  • Mining permit: means a permit issued under this part for conducting nonferrous metallic mineral mining and reclamation operations. See Michigan Laws 324.63201
  • Minor repair: means a repair that involves only the clearance of stoppages, repair, or replacement of a faucet or valve or reinstallation of that same plumbing fixture and does not involve making any modifications to the plumbing system, or residential domestic water treatment and filtering equipment.   • Minor repair work: means electrical wiring that has a value of $100. See Michigan Laws 339.5703
  • Modified household income: means the gross annual income from all sources and before taxes or withholding of all individuals of a household living in a residential dwelling unit or housing unit after deducting all of the following:
  •     (i) Unusual or temporary income of any member of the household. See Michigan Laws 207.902
  • Modified household income: means the gross annual income from all sources and before taxes or withholding of all individuals of a household living in a residential dwelling unit or housing unit after deducting all of the following:

  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Motor carrier: means :
  •     (i) A person who operates or causes to be operated a qualified commercial motor vehicle on a public road or highway in this state and at least 1 other state or Canadian province. See Michigan Laws 207.211
  • Motor fuel: means diesel fuel as defined in section 2 of the motor fuel tax act, 2000 PA 403, MCL 207. See Michigan Laws 207.211
  • Motor fuel: means gasoline, diesel fuel, kerosene, a mixture of gasoline, diesel fuel, or kerosene, or a mixture of gasoline, diesel fuel, or kerosene and any other substance. See Michigan Laws 207.1004
  • Motor vehicle: means that term as defined in section 33 of the Michigan vehicle code, Act No. See Michigan Laws 207.372
  • Motor vehicle: means a motor vehicle subject to registration and certificate of title under section 216 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 207.751
  • Motor vehicle: means a vehicle that is propelled by an internal combustion engine or motor and is designed to permit the vehicle's mobile use on the public roads or highways of this state. See Michigan Laws 207.1004
  • Multifamily residential use: means multifamily housing consisting of 5 or more units. See Michigan Laws 207.842
  • Multimodal commerce: means the movement of products or services via 2 of the following:
  •     (i) Air. See Michigan Laws 207.803
  • Municipality: means a city, village, or township. See Michigan Laws 339.5107
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC

  • Natural brine: means naturally occurring mineralized water other than potable or fresh water. See Michigan Laws 324.62501
  • Net gallons: means the remaining product, after all considerations and deductions have been made, measured in gallons, corrected to a temperature of 60 degrees Fahrenheit, 13 degrees Celsius, and a pressure of 14. See Michigan Laws 207.1004
  • New capital investment: means 1 or more of the following:
  •     (i) New construction. See Michigan Laws 207.803
  • New construction: means property not in existence on the date the authorized business enters into a written agreement with the authority and not replacement construction. See Michigan Laws 207.803
  • New facility: means a new structure which will have as its primary purpose multifamily housing consisting of 5 or more units and will be constructed in a downtown development district established pursuant to Act No. See Michigan Laws 207.601
  • New facility: means attainable housing property newly constructed on or after the effective date of this act. See Michigan Laws 207.902
  • new personal property: means personal property that is not subject to or that is exempt from the collection of taxes under the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.803
  • New residential facility: means residential housing property newly constructed on or after the effective date of this act. See Michigan Laws 207.952
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nonferrous metallic mineral: means any ore or material to be excavated from the natural deposits on or in the earth for its metallic content, but not primarily for its iron or iron mineral content, to be used for commercial or industrial purposes. See Michigan Laws 324.63201
  • Oath: A promise to tell the truth.
  • oath: shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word "sworn" shall be construed to include the word "affirmed". See Michigan Laws 8.3k
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Occupation: means a field of endeavor regulated under this act. See Michigan Laws 339.5107
  • Operator: means a person engaged in the business of controlling or operating an airport parking facility. See Michigan Laws 207.372
  • Operator: means the person, whether owner or not, supervising or responsible for the drilling, operating, repairing, abandoning, or plugging of wells subject to this part. See Michigan Laws 324.62501
  • operator: means a person who owns or leases the plant and equipment utilized in a mining area and is engaged in the business of mining ferrous minerals or preparing to engage in mining operations. See Michigan Laws 324.63101
  • Outline lighting: means an arrangement of incandescent lamps or electric discharge tubing that is an integral part of an electrical sign that outlines certain features, such as the shape of a building or the decoration of a window. See Michigan Laws 339.5703
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means the person who has the right to drill, convert, or operate any well subject to this part. See Michigan Laws 324.62501
  • Oxygenate: means an oxygen-containing, ashless, organic compound, such as an alcohol or ether, which may be used as a fuel or fuel supplement. See Michigan Laws 207.1004
  • parent: includes an individual who is pregnant. See Michigan Laws 37.2103
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Permissive supplier: means a person who may not be subject to the taxing jurisdiction of this state but who does meet both of the following requirements:
  •     (i) Is a position holder in a federally registered terminal located outside of this state, or a person who acquires from a position holder motor fuel in an out-of-state terminal in a transaction that otherwise qualifies as a 2-party exchange under this act. See Michigan Laws 207.1004
  • Permittee: means a person who holds a mining permit. See Michigan Laws 324.63201
  • Person: means a natural person, partnership, firm, association, joint stock company, limited liability company, limited liability partnership, syndicate, or corporation, and any receiver, trustee, conservator, or officer, other than a unit of government, having jurisdiction and control of property by virtue of law or by appointment of a court. See Michigan Laws 207.211
  • Person: means a natural person, partnership, fiduciary, association, corporation, or other legal entity. See Michigan Laws 207.372
  • Person: means an individual, partnership, corporation, limited liability company, association, governmental entity, or other legal entity. See Michigan Laws 207.522
  • Person: means a natural person, partnership, limited partnership, fiduciary, association, corporation, limited liability company, or other entity. See Michigan Laws 207.623
  • Person: means an individual, partnership, corporation, association, or other legal entity. See Michigan Laws 207.751
  • Person: means and includes an individual, cooperative, partnership, firm, association, limited liability company, limited liability partnership, joint stock company, syndicate, and corporation, both private and municipal, and any receiver, trustee, conservator, or any other officer having jurisdiction and control of property by law or by appointment of a court other than units of government. See Michigan Laws 207.1004
  • Person: means a natural person notwithstanding section 105(5). See Michigan Laws 339.2001
  • Person: includes an individual, agent, association, corporation, joint apprenticeship committee, joint-stock company, labor union, legal representative, mutual company, partnership, receiver, trust, trustee in bankruptcy, unincorporated organization, this state, or any other legal, commercial, or governmental entity or agency. See Michigan Laws 37.1103
  • Person: means an individual, agent, association, corporation, joint apprenticeship committee, joint stock company, labor organization, legal representative, mutual company, partnership, receiver, trust, trustee in bankruptcy, unincorporated organization, this state or a political subdivision of this state or an agency of this state, or any other legal or commercial entity. See Michigan Laws 37.2103
  • Person: means an individual, sole proprietorship, partnership, association, limited liability company, corporation, or common law trust or a combination of those legal entities. See Michigan Laws 339.5107
  • Person: means an individual, partnership, corporation, association, governmental entity, or other legal entity. See Michigan Laws 324.301
  • person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l
  • Person in responsible charge: means a person licensed under this article who determines technical questions of design and policy; advises the client; supervises and is in responsible charge of the work of subordinates; is the person whose professional skill and judgment are embodied in the plans, designs, plats, surveys, and advice involved in the services; and who supervises the review of material and completed phases of construction. See Michigan Laws 339.2001
  • Personal property: All property that is not real property.
  • Plan reviewer: means an individual who is engaged in the practice of examining construction documents for the purpose of determining compliance with applicable codes. See Michigan Laws 339.6003
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Plumbing: means the practice, materials, and fixtures, in or adjacent to a building, structure, or premises, used in the installation, maintenance, extension, or alteration of all piping, fixtures, plumbing appliances, or plumbing appurtenances, as defined in the state construction code, in connection with the sanitary drainage or storm drainage facilities, plumbing venting systems, medical gas systems, backflow preventers, and public or private water supply systems. See Michigan Laws 339.6103
  • Plumbing contractor: means a licensed master plumber or a person who employs a licensed master plumber full-time to directly supervise the installation of plumbing as his or her representative engaged in the business of plumbing for a fixed sum, price, fee percentage, valuable consideration, or other compensation and who is licensed as a plumbing contractor. See Michigan Laws 339.6103
  • Pocket card: means the pocket card that contains information about the license that the department provides under section 2506 when it issues a license under this article. See Michigan Laws 339.2501
  • Political subdivision: means a county, city, village, township, school district, or special district or authority of this state. See Michigan Laws 37.2103
  • Position holder: means a person who has a contract with a terminal operator for the use of storage facilities and other terminal services for motor fuel at the terminal, as reflected in the records of the terminal operator. See Michigan Laws 207.1004
  • Power boiler: means a closed vessel in which steam or other vapor is generated at a pressure of more than 15 p. See Michigan Laws 339.5903
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Practice of architecture: means professional services, such as consultation, investigation, evaluation, planning, design, or review of material and completed phases of work in construction, alteration, or repair in connection with a public or private structure, building, equipment, works, or project if the professional service requires the application of a principle of architecture or architectural design. See Michigan Laws 339.2001
  • Practice of embalming: means the disinfecting or preserving of a dead human body, entirely or in part, by the use of a chemical substance, fluid, or gas in the body or by the introduction of a chemical substance, fluid, or gas into the body by a vascular or hypodermic injection, or by direct application into an organ or cavity. See Michigan Laws 339.1801
  • Practice of funeral directing: means engaging in or representing oneself as engaging in the supervising of the burial and disposal of a dead human body, managing a funeral establishment for the preparation, disposition, and care of a dead human body, or using, in connection with the user's name or funeral establishment, the word "funeral director" "funeral service professional" "undertaker" or "mortician" or any other title embodying the words "mortuary science" or otherwise implying that the individual is engaged as a funeral director. See Michigan Laws 339.1801
  • Practice of landscape architecture: means all of the following:
  •     (i) The performance of professional services such as consultation, investigation, research, planning, design, or responsible field observation in connection with the development of land areas where, and to the extent that the dominant purpose of the services is the preservation, enhancement, or determination of proper land uses, natural land resources, ground cover and planting, naturalistic and aesthetic values, the settings and approaches to structures or other improvements, natural drainage, and the consideration and determination of inherent problems of the land relating to erosion, use and stress, blight, or other hazards. See Michigan Laws 339.2201
  • Practice of mortuary science: means the practice of embalming or the practice of funeral directing, or both. See Michigan Laws 339.1801
  • Practice of professional engineering: means professional services, such as consultation, investigation, evaluation, planning, design, or review of material and completed phases of work in construction, alteration, or repair in connection with a public or private utility, structure, building, machine, equipment, process, work, or project, if the professional service requires the application of engineering principles or data. See Michigan Laws 339.2001
  • Practice of professional surveying: means providing professional services such as consultation, investigation, testimony, evaluation, planning, mapping, assembling, and interpreting reliable scientific measurements and information relative to the location, size, shape, or physical features of the earth, improvements on the earth, the space above the earth, or any part of the earth, and the utilization and development of these facts and interpretations into an orderly survey map, plan, report, description, or project. See Michigan Laws 339.2001
  • Prelicensure course: means a course that is represented to the public as fulfilling, in whole or in part, the requirements of section 2504. See Michigan Laws 339.2501
  • Principal: means a sole proprietor, partner, the president, vice-president, secretary, treasurer, or director of a corporation, or a member or manager of a limited liability company. See Michigan Laws 339.2001
  • Process boiler: means a boiler that is operated at a pressure or temperature from which more than 10% of the boiler's capacity is used for direct steam humidification or direct process work. See Michigan Laws 339.5903
  • Process piping: means any piping which is not part of a system designed to provide air conditioning or of a refrigeration system. See Michigan Laws 339.5803
  • Professional designation: means a certification from a real estate professional association that demonstrates that an individual has attained proven skills or education in a real estate occupational area and may include the right to use a title or letters after the licensee's name that represent the designation awarded by the certifying entity. See Michigan Laws 339.2501
  • Professional engineer: means a person who, by reason of knowledge of mathematics, the physical sciences, and the principles of engineering, acquired by professional education and practical experience, is qualified to engage in the practice of professional engineering. See Michigan Laws 339.2001
  • Professional surveyor: means a person who, by reason of knowledge of law, mathematics, physical sciences, and techniques of measuring acquired by professional education and practical experience, is qualified to engage in the practice of professional surveying. See Michigan Laws 339.2001
  • property: means 1 of the following:
  •     (a) Except as otherwise provided in subdivision (b), all property, real or personal, belonging to the persons, corporations, companies, copartnerships, and associations subject to taxation under this act, including rights-of-way, road beds, stations, cars, rolling stock, tracks, wagons, horses, office furniture, telegraph and telephone poles, wires, conduits, switchboards, all other property used in carrying on their business and owned by them respectively, all other real and personal property, and all franchises. See Michigan Laws 207.5
  • Property: includes land, tenements, real estate, and real property and all rights to and interests in land, tenements, real estate, or real property. See Michigan Laws 207.522
  • property having a situs in this state: includes all of the following:
  •     (a) Except as otherwise provided in subdivision (b), the property, real and personal, of the persons, corporations, companies, copartnerships, and associations subject to taxation under this act, owned, used, and occupied by them within this state, and also the proportion of their rolling stock, cars, and other property used partly within and partly outside of this state as provided in this act. See Michigan Laws 207.5
  • Property management: means leasing or renting, or offering to lease or rent, real property of others for a fee, commission, compensation, or other valuable consideration pursuant to a property management employment contract. See Michigan Laws 339.2501
  • Property management account: means an interest-bearing or noninterest-bearing account or instrument used in the operation of property management. See Michigan Laws 339.2501
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • protective hairstyles: includes , but is not limited to, such hairstyles as braids, locks, and twists. See Michigan Laws 37.2103
  • Provisional registration: means a building official, plan reviewer, or inspector who is registered subject to his or her completion of the amount of training, education, and experience required by the commission and the appropriate advisory board and described in section 1007(2). See Michigan Laws 339.6003
  • Public access: means the right of a person to view and copy files under the freedom of information act, 1976 PA 442, MCL 15. See Michigan Laws 339.5107
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public roads or highways: means a road, street, or place maintained by this state or a political subdivision of this state and generally open to use by the public as a matter of right for the purpose of vehicular travel, notwithstanding that they may be temporarily closed or travel restricted for the purpose of construction, maintenance, repair, or reconstruction. See Michigan Laws 207.211
  • Public roads or highways: means a road, street, or place maintained by this state or a political subdivision of this state and generally open to use by the public as a matter of right for the purpose of vehicular travel, notwithstanding that they may be temporarily closed or travel is restricted for the purpose of construction, maintenance, repair, or reconstruction. See Michigan Laws 207.1004
  • Public-private arrangement: means a public-private arrangement authorized under the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.623
  • qualified city: means that term as defined in section 5 of the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.629
  • Qualified county: means a county that provides public services to a regional airport facility. See Michigan Laws 207.372
  • Qualified facility: means a qualified retail food establishment or a building or group of contiguous buildings of commercial property that is 15 years old or older or has been allocated for a new markets tax credit under section 45D of the internal revenue code, 26 USC 45D. See Michigan Laws 207.842
  • Qualified facility: means a new facility or a rehabilitated facility, located in an attainable housing district. See Michigan Laws 207.902
  • Qualified high-technology business: means a business or facility whose primary business activity is high-technology activity or a qualified high-wage activity. See Michigan Laws 207.803
  • Qualified high-wage activity: means a business that has an average wage of 300% or more of the federal minimum wage. See Michigan Laws 207.803
  • qualified local governmental unit: means , except as otherwise provided in this subsection, a city, village, township, county, or authority that is located in, or includes within its territory or jurisdiction, a county in which convention hotels are located and that either is the owner or lessee of a convention facility with 350,000 square feet or more of total exhibit space on July 30, 1985 or, if such a convention facility does not exist, will be the owner or lessee of a convention facility with 350,000 square feet or more of total exhibit space through the application of distributions under this section to the purchase or lease of a convention facility.   • Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.842
  • Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.902
  • Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.952
  • Qualified lodging facility: means 1 or more of the following:
  •     (i) Lodging facilities that constitute a portion of a tourism attraction facility and represent less than 50% of the total cost of the tourism attraction facility, or the lodging facilities are to be located on recreational property owned or leased by the municipal, state, or federal government. See Michigan Laws 207.803
  • Qualified new job: means 1 of the following:
  •     (i) A full-time job created by an authorized business at a facility that is in excess of the number of full-time jobs the authorized business maintained in this state prior to the expansion or location, as determined by the authority. See Michigan Laws 207.803
  • Qualified residential facility: means a new residential facility or a rehabilitated residential facility, located in a residential housing district. See Michigan Laws 207.952
  • Qualified retail food establishment: means property that meets all of the following:
  •     (i) The property will be used primarily as a retail supermarket, grocery store, produce market, or delicatessen that offers unprocessed USDA-inspected meat and poultry products or meat products that carry the USDA organic seal, fresh fruits and vegetables, and dairy products for sale to the public. See Michigan Laws 207.842
  • Qualified technical education program: means an educational program that is approved by the board and that has a minimum of 350 contact hours in classroom hands-on training, field training, or supervised plant visits for high pressure boiler operators. See Michigan Laws 339.5903
  • Qualified training program: means any of the following:
  •     (i) An in-house training program approved by the board and offered to boiler operators and stationary engineers by an employer. See Michigan Laws 339.5903
  • Quorum: The number of legislators that must be present to do business.
  • Rack: means a mechanism for delivering motor fuel from a refinery, a terminal, or a marine vessel into a railroad tank car, a transport truck, a tank wagon, the fuel supply tank of a marine vessel, or other means of transfer outside of the bulk transfer/terminal system. See Michigan Laws 207.1005
  • Real estate appraisal services: means the practice of developing an opinion of the value of real property in a manner that conforms with the uniform standards of professional appraisal practice. See Michigan Laws 339.2661
  • Real estate broker: means an individual or business entity that, with intent to collect or receive a fee, compensation, or valuable consideration, sells or offers for sale, buys or offers to buy, provides or offers to provide market analyses of, lists or offers or attempts to list, or negotiates the purchase, sale, or exchange of real estate; that negotiates the mortgage of real estate; that negotiates for the construction of a building on real estate; that leases or offers or rents or offers for rent real estate or the improvements on the real estate for others, as a whole or partial vocation; that engages in property management as a whole or partial vocation; that sells or offers for sale, buys or offers to buy, leases or offers to lease, or negotiates the purchase or sale or exchange of a business, business opportunity, or the goodwill of an existing business for others; or that, as owner or otherwise, engages in the sale of real estate as a principal vocation. See Michigan Laws 339.2501
  • Real estate broker or salesman: means a person, whether licensed or not, who, for or with the expectation of receiving a consideration, lists, sells, purchases, exchanges, rents, or leases real property, or who negotiates or attempts to negotiate any of these activities, or who holds himself out as engaged in these activities, or who negotiates or attempts to negotiate a loan secured or to be secured by a mortgage or other encumbrance upon real property, or who is engaged in the business of listing real property in a publication; or a person employed by or acting on behalf of any of these persons. See Michigan Laws 37.1501
  • Real estate related financial transaction: means any of the following:
  •     (i) A sale, lease, purchase, investment in, or exchange of real property or the financing of real property. See Michigan Laws 339.2601
  • Real estate salesperson: means an individual who for compensation or valuable consideration is employed either directly or indirectly by a licensed real estate broker to sell or offer to sell, buy or offer to buy, provide or offer to provide market analyses of, list or offer or attempt to list, or negotiate the purchase, sale, or exchange of real estate; to negotiate the mortgage of real estate; to negotiate for the construction of a building on real estate, or to lease or offer to lease, or rent or offer for rent, real estate; who is employed by a real estate broker to engage in property management; or who sells or offers for sale, buys or offers to buy, leases or offers to lease, or negotiates the purchase or sale or exchange of a business, business opportunity, or the goodwill of an existing business for others, as a whole or partial vocation. See Michigan Laws 339.2501
  • Real estate transaction: means the sale, exchange, rental, or lease of real property, or an interest therein. See Michigan Laws 37.1501
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Real property: includes a building, structure, mobile home, real estate, land, mobile home park, trailer park, tenement, leasehold, or an interest in a real estate cooperative or condominium. See Michigan Laws 37.1501
  • Real property: means an identified tract or parcel of land, including improvements on that land, as well as any interests, benefits, or rights inherent in the land. See Michigan Laws 339.2601
  • Refiner: means a person who owns, operates, or otherwise controls a refinery within the United States. See Michigan Laws 207.1005
  • Refinery: means a facility used to produce motor fuel from crude oil, unfinished oils, natural gas liquids, or other hydrocarbons and from which motor fuel may be removed by pipeline, by marine vessel, or at a rack. See Michigan Laws 207.1005
  • Refrigeration: means the use of equipment and systems, including, but not limited to, refrigeration piping, employing the refrigeration cycle to generate low temperatures for other than air conditioning equipment and systems. See Michigan Laws 339.5803
  • Regional airport facility: means an airport that services 4,000,000 or more enplanements annually. See Michigan Laws 207.372
  • Registered: means a building official, plan reviewer, inspector, fire protection system inspector, or fire protection system plan reviewer who is registered under this article. See Michigan Laws 339.6003
  • Rehabilitated facility: means existing attainable housing property that has been renovated, with a renovation investment of not less than $5,000. See Michigan Laws 207.902
  • Rehabilitated residential facility: means existing residential housing property that has been renovated, with a renovation investment of not less than $50,000. See Michigan Laws 207.952
  • Rehabilitation: means changes to a qualified facility that are required to restore or modify the property, together with all appurtenances, to an economically efficient condition. See Michigan Laws 207.842
  • Related wiring: means any of the following:
  •     (i) Except as otherwise provided in subparagraphs (i), (ii), (iii), and (iv), that portion of the electric sign wiring that originates at the load-side terminals of a disconnecting means located in the vicinity of the electric sign involved but does not include the installation of the disconnecting means, complete with line-side connections. See Michigan Laws 339.5703
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • removed: means a physical transfer other than by evaporation, loss, or destruction of motor fuel from a terminal, manufacturing plant, customs custody, pipeline, marine vessel, or refinery that stores motor fuel. See Michigan Laws 207.1005
  • Replacement construction: means that term as defined in section 34d(1)(b)(v) of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.803
  • Resident trainee: means an individual who is engaged in learning the practice of embalming or funeral directing or the practice of mortuary science under the instruction and personal supervision of a holder of a license for the practice of mortuary science in this state. See Michigan Laws 339.1801
  • Residential builder: means any of the following:
  •     (i) A person engaged in the construction of a residential structure that, for a fixed sum, price, fee, percentage, valuable consideration, or other compensation, other than wages for personal labor only, undertakes with another or offers to undertake, or purports to have the capacity to undertake with another, for the erection, construction, replacement, repair, alteration, or addition to, subtraction from, improvement, wrecking of, or demolition of, a residential structure. See Michigan Laws 339.2401
  • Residential housing property: means that portion of real property not occupied by an owner of that real property, that is used for residential purposes, is rented or leased to an income-qualified household at no more than 30% of the household's modified household income as determined by the qualified local governmental unit, and is either a multiple-unit dwelling of more than 4 units or a dwelling unit in a multiple-purpose structure of more than 4 dwelling units. See Michigan Laws 207.952
  • Residential maintenance and alteration contractor: means a person that, for a fixed sum, price, fee, percentage, valuable consideration, or other compensation, other than wages for personal labor only, does any of the following:
  •     (i) Undertakes with another for the repair, alteration, or addition to, subtraction from, improvement of, wrecking of, or demolition of a residential structure, or building of a garage, or laying of concrete on residential property. See Michigan Laws 339.2401
  • Residential real property: means real property used as a residence containing a dwelling that has not more than 4 living units. See Michigan Laws 339.2601
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Retail diesel dealer: means a person who sells or distributes diesel fuel to an end user in this state. See Michigan Laws 207.1005
  • Retail marine diesel dealer: means a person who sells or distributes diesel fuel to an end user in this state for use in boats or other marine vessels. See Michigan Laws 207.1005
  • Retained jobs: means the number of full-time jobs at a facility of an authorized business maintained in this state on a specific date as that date and number of jobs is determined by the authority. See Michigan Laws 207.803
  • Room charge: means the charge imposed for the use or occupancy of accommodations, excluding charges for food, beverages, telephone services, the use tax imposed under the use tax act, 1937 PA 94, MCL 205. See Michigan Laws 207.623
  • Rule: means a rule promulgated under the administrative procedures act of 1969. See Michigan Laws 339.5107
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 324.301
  • Rural business: means an eligible business located in a county with a population of 90,000 or less. See Michigan Laws 207.803
  • Salesperson: means an employee or agent, other than a qualifying officer, of a licensed residential builder or residential maintenance and alteration contractor, who for a salary, wage, fee, percentage, commission, or other consideration, sells or attempts to sell, negotiates or attempts to negotiate, solicits for or attempts to solicit for, obtains or attempts to obtain a contract or commitment for, or furnishes or attempts or agrees to furnish, the goods and services of a residential builder or residential maintenance and alteration contractor, except an individual working for a licensed residential builder or residential maintenance and alteration contractor who makes sales that are occasional and incidental to the individual's principal employment.   • seal: shall be construed to include any of the following:
  •     (a) The impression of the seal on the paper alone. See Michigan Laws 8.3n
  • Service of process: The service of writs or summonses to the appropriate party.
  • Service provision agreement: means a buyer agency agreement or listing agreement that is executed by a real estate broker and a client and establishes an agency relationship. See Michigan Laws 339.2501
  • Services: means professional service offered or provided by an architect in the practice of architecture, a professional engineer in the practice of professional engineering, or a professional surveyor in the practice of professional surveying. See Michigan Laws 339.2001
  • Servicing: means the maintenance, repair, and servicing of previously installed equipment and systems. See Michigan Laws 339.5803
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sex: includes , but is not limited to, pregnancy, childbirth, the termination of a pregnancy, or a related medical condition. See Michigan Laws 37.2201
  • Sexual orientation: means having an orientation for heterosexuality, homosexuality, or bisexuality or having a history of such an orientation or being identified with such an orientation. See Michigan Laws 37.2103
  • shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c
  • Sign specialist: means an individual who, as his or her principal occupation, is engaged in the installation, alteration, or repair of electric signs. See Michigan Laws 339.5703
  • Sign specialty contractor: means a person that is engaged in the business of manufacturing, installing, maintaining, connecting, or repairing electric sign wiring or devices, including wiring that is directly related to electric signs and is electrically dedicated as a sign circuit. See Michigan Laws 339.5703
  • Sign specialty licensure: means licensure as a sign specialist or sign specialty contractor. See Michigan Laws 339.5703
  • Source state: means the state, Canadian province or territory, or foreign country from which motor fuel is imported. See Michigan Laws 207.1005
  • specific tax: means the specific tax levied under this act. See Michigan Laws 207.902
  • specific tax: means the specific tax levied under this act. See Michigan Laws 207.952
  • Sponsor: means a person that represents to the public that the courses it conducts for purposes of this article fulfill the requirements of section 2504a for continuing education. See Michigan Laws 339.2501
  • Stadium: means a facility, including necessary sites, related parking lots or structures, and appurtenant properties and facilities, that is intended to provide space for any of the following:
  •     (i) A professional baseball franchise, if the facility itself contains not less than 25,000 seats and is located in the downtown area of the most populous city in the eligible county. See Michigan Laws 207.751
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • State construction code: means the rules promulgated by the state construction code commission under section 4 of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5107
  • State licensed real estate appraiser: means an individual who is licensed under section 2610 to appraise real property, including, but not limited to, residential and nonresidential real property involving federally related transactions and real estate related financial transactions. See Michigan Laws 339.2601
  • Stationary engine: means a temporary or permanently affixed engine designed and used to supply power primarily for agricultural or construction work. See Michigan Laws 207.1005
  • stationary engineer: means an individual who is engaged in the operation of boilers and associated auxiliaries. See Michigan Laws 339.5901
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Stille-DeRossett-Hale single state construction code act: means 1972 PA 230, MCL 125. See Michigan Laws 339.5107
  • Stockpile: means material, including, but not limited to, surface overburden, rock, or lean ore, that in the process of ferrous mineral mining and beneficiation or treatment has been removed from the earth and stored on the surface. See Michigan Laws 324.63101
  • Stockpile: means material, including, but not limited to, surface overburden, rock, or lean ore, that in the process of mining and beneficiation or treatment has been removed from the earth and stored on the surface. See Michigan Laws 324.63201
  • Storage well: means a well drilled into a subsurface formation to develop an underground storage cavity for subsequent use in storage operations. See Michigan Laws 324.62501
  • Subpoena: A command to a witness to appear and give testimony.
  • Subsidiary business: means a business that is directly or indirectly controlled or at least 80% owned by an authorized business. See Michigan Laws 207.803
  • Supervisor of mineral wells: means the state geologist. See Michigan Laws 324.62501
  • Supervisor of reclamation: means the department. See Michigan Laws 324.63101
  • Surface or open pit mining: means the mining of more than 10,000 tons of a ferrous mineral or disturbing more than 1 acre of land a year in the regular operation of a business either by removing the overburden lying above a natural deposit of a ferrous mineral and mining directly from the natural deposit exposed or by mining directly from a deposit lying exposed in the ferrous mineral's natural state.   • Tank wagon: means a straight truck having 1 or more compartments other than the fuel supply tank designed or used to carry motor fuel. See Michigan Laws 207.1006
  • Tank wagon operator-importer: means a person who operates a tank wagon and imports motor fuel into this state from another state. See Michigan Laws 207.1006
  • Tax: means the state real estate transfer tax imposed under this act. See Michigan Laws 207.522
  • Tax: means a tax, interest, or penalty levied under this act. See Michigan Laws 207.1006
  • Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.842
  • Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.902
  • Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.952
  • Terminal: means a motor fuel storage and distribution facility that meets all of the following requirements:
  •     (i) Is registered as a qualified terminal by the internal revenue service. See Michigan Laws 207.1006
  • Terminal operator: means a person who owns, operates, or otherwise controls a terminal. See Michigan Laws 207.1006
  • Test well: means a well, core hole, core test, observation well, or other well drilled from the surface to determine the presence of a mineral, mineral resource, ore, or rock unit, or to obtain geological or geophysical information or other subsurface data related to mineral exploration and extraction. See Michigan Laws 324.62501
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Tourism attraction facility: means a cultural or historical site, a recreation or entertainment facility, an area of natural phenomena or scenic beauty, or an entertainment destination center as determined by the Michigan economic growth authority as follows:
  •     (i) In making a determination, the Michigan economic growth authority shall consider all of the following:
        (A) Whether the facility will actually attract tourists. See Michigan Laws 207.803
  • Transaction: means the parking, storing, housing, or keeping of a motor vehicle for consideration. See Michigan Laws 207.372
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transmix: means the mixed product that results from the buffer or interface of 2 different products in a pipeline shipment, or a mixture of 2 different products within a refinery or terminal that results in an off-grade mixture. See Michigan Laws 207.1006
  • Transport truck: means a semitrailer combination rig designed or used for the purpose of transporting motor fuel over the public roads or highways. See Michigan Laws 207.1006
  • Transporter: means an operator of a railroad or rail car, tank wagon, transport truck, or other fuel transportation vehicle engaged in the business of transporting motor fuel below the terminal rack. See Michigan Laws 207.1006
  • Treasurer: means the state treasurer. See Michigan Laws 207.522
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trustee: A person or institution holding and administering property in trust.
  • Truth in Lending Act: The Truth in Lending Act is a federal law that requires lenders to provide standardized information so that borrowers can compare loan terms. In general, lenders must provide information on Source: OCC
  • Ultimate vendor: means the person who sells motor fuel to the end user of the fuel. See Michigan Laws 207.1006
  • Underground waste: means damage or injury to potable water, mineralized water, or other subsurface resources. See Michigan Laws 324.62501
  • Underserved area: means an area determined by the Michigan department of agriculture that contains a low or moderate income census tract and a below average supermarket density, an area that has a supermarket customer base with more than 50% living in a low income census tract, or an area that has demonstrated significant access limitations due to travel distance. See Michigan Laws 207.842
  • Uniform standards of professional appraisal practice: means all of the following, if applicable:
  •     (i) Standards relating to real property adopted by the appraisal foundation and in effect on the effective date of the amendatory act that added subparagraph (ii). See Michigan Laws 339.2601
  • Uniform standards of professional appraisal practice: means that term as defined in section 2601. See Michigan Laws 339.2661
  • Uniformed services: means the Commissioned Corps of the United States Public Health Service and the National Oceanic and Atmospheric Administration Commissioned Officer Corps. See Michigan Laws 339.5107
  • United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
  • Unlimited heating service: means the servicing of heating equipment and systems without restrictions concerning thermal capacity or grade of fuel oil or type of fuel. See Michigan Laws 339.5803
  • Unlimited refrigeration and air conditioning service: means the servicing of refrigeration equipment and systems and air conditioning equipment and systems employing the refrigeration cycle unlimited as to thermal capacity or type of refrigerant. See Michigan Laws 339.5803
  • Value: means the current or fair market worth in terms of legal monetary exchange at the time of the transfer. See Michigan Laws 207.522
  • Veteran: means that term as defined in section 1 of 1965 PA 190, MCL 35. See Michigan Laws 339.5107
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Water service pipe: means the pipe from the water main or other source of potable water supply to the water distributing system of the building served. See Michigan Laws 339.6103
  • Wholesaler: means a person who acquires motor fuel from a supplier or from another wholesaler for subsequent sale and distribution at wholesale by a fuel transportation vehicle, rail car, or other motor vehicle. See Michigan Laws 207.1006
  • Written agreement: means a written agreement made pursuant to section 8. See Michigan Laws 207.803
