(a) Except as provided by Subsection (b), (c), or (d) of this section, a person who violates any provision of this chapter or rule adopted under this chapter commits an offense that is a Class C misdemeanor.
(b) A person who violates § 134.020 commits an offense that is a Class B misdemeanor.

- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Rule: includes regulation. See Texas Government Code 311.005
(c) A person who violates § 134.022(b) of this code by taking cultured species of a value of $200 or more but less than $750 commits an offense that is a Class A misdemeanor.
(d) A person who violates § 134.022(b) of this code by taking cultured species of a value of $750 or more commits an offense that is a felony of the third degree.
