Terms Used In Texas Alcoholic Beverage Code 107.09

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Liquor: means any alcoholic beverage, other than a malt beverage, containing alcohol in excess of five percent by volume, unless otherwise indicated. See Texas Alcoholic Beverage Code 1.04
  • Written: includes any representation of words, letters, symbols, or figures. See Texas Government Code 311.005

If the holder of a general or branch distributor’s license also holds a wholesaler’s or general class B wholesaler’s permit, a written statement or invoice required as evidence of the sale of malt beverages or liquor may be on the same business form that is designed to reflect the sale of both liquor and malt beverages, if all information required by this code to be shown on a statement or invoice is reflected on the form and all other records required by this code are maintained.
