(a) A person may file an application for a license to manufacture, distribute, store, or sell malt beverages with the commission on forms prescribed by the commission.
(b) On receipt of an application for a license under this code, the commission shall follow the procedure under Section 11.43.
Terms Used In Texas Alcoholic Beverage Code 61.31
- Applicant: means a person who submits or files an original or renewal application with the commission for a license or permit. See Texas Alcoholic Beverage Code 1.04
- Commission: means the Texas Alcoholic Beverage Commission. See Texas Alcoholic Beverage Code 1.04
- Person: means a natural person or association of natural persons, trustee, receiver, partnership, corporation, organization, or the manager, agent, servant, or employee of any of them. See Texas Alcoholic Beverage Code 1.04
- Rule: includes regulation. See Texas Government Code 311.005
(c) Each applicant for an original license shall pay the license fee authorized by commission rule.
(d) A person may not sell malt beverages during the pendency of the person’s original license application. An official may not advise a person to the contrary.
