(a) A person who violates this chapter or a rule adopted under this chapter is liable to the state for a civil penalty.
(b) The attorney general or the executive director may bring an action to collect a penalty under this section.
Terms Used In Texas Business and Commerce Code 607.1021
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Rule: includes regulation. See Texas Government Code 311.005
(c) The provisions of § 51.352, Occupations Code, relating to an action to collect and the amount of a civil penalty under that section apply to an action to collect and the amount of a civil penalty under this section.
