- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
Unless otherwise provided by the agreement to arbitrate, a party at the hearing is entitled to:
(1) be heard;
(2) present evidence material to the controversy; and
(3) cross-examine any witness.
