Terms Used In Texas Code of Criminal Procedure 17.091

  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

Before a judge or magistrate reduces the amount of bail set for a defendant charged with an offense listed in Article 42A.054 or an offense described by Article 62.001(5), the judge or magistrate shall provide:
(1) to the attorney representing the state, reasonable notice of the proposed bail reduction; and
(2) on request of the attorney representing the state or the defendant or the defendant’s counsel, an opportunity for a hearing concerning the proposed bail reduction.
