(1) The individual defendant has not been arrested;

Terms Used In Texas Code of Criminal Procedure 29.01

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

(2) A defendant corporation or association has not been served with summons; or
(3) There is not sufficient time for trial at that term of court.
