(a) Subject to Subsection (b), the department must obtain a court order from a court of competent jurisdiction to compel the family of a child who is a candidate for foster care to obtain family preservation services and complete the family preservation services plan.
(b) The department is not required to obtain a court order to provide family preservation services to a pregnant or parenting foster youth.
