(a) The commission, when acting under Chapter 663, is not an occupying state agency for purposes of § 1232.201.
(b) The commission or the appropriate state agency shall include in the schedules developed under § 1232.201(a) the method of charging state agencies that occupy all or part of a building to which § 1232.201 applies for the space in the building that is used for a child-care facility under Chapters 663, 2165, and 2166.

(c) An occupying agency’s share shall be determined at least in part on the ratio of the number of the occupying agency’s employees who work in the building to the total number of state employees who work in the building.
