(a) A state agency that contracts for a construction project, including a project under § 2166.003, shall make a good faith effort to increase the construction contract awards that the agency expects to make during a fiscal year to historically underutilized businesses based on rules adopted by the comptroller to implement the disparity study described by § 2161.002(c).
(b) In this section, “project” has the meaning assigned by § 2166.001.

The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
