Terms Used In Texas Government Code 424.056
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Property: means real and personal property. See Texas Government Code 311.005
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
If a defendant is convicted of an offense under this subchapter and the offense results in damage to or destruction of property, a court may, in accordance with Article 42.037, Code of Criminal Procedure, order the defendant to make restitution to the owner of the damaged or destroyed property, or the owner’s designee, in an amount equal to the value of the property on the date of the damage or destruction.
