(a) The executive commissioner shall adopt rules under which the commission requires a nursing facility in which a child resides to request from the child’s parent or guardian a written reauthorization of the child’s plan of care.
(b) The rules must require that the written reauthorization be requested annually.

- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
