(a) A person commits an offense if the person commits an offense under § 557.011(a) and the sabotage or attempted sabotage causes the death of an individual.
(b) An offense under this section is punishable by:
(1) death; or
(2) confinement in the Texas Department of Criminal Justice for:
(A) life; or
(B) a term of not less than two years.
Terms Used In Texas Government Code 557.012
- Justice: when applied to a magistrate, means justice of the peace. See Texas Government Code 312.011
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
(c) If conduct constituting an offense under this section also constitutes an offense under other law, the actor may be prosecuted under both sections.
