(a) Except as provided by Subsections (b) and (c), if a member who has at least eight years of service credit in the elected class of membership dies, a death benefit annuity is payable in an amount computed at the rate of one-half of the standard service retirement annuity to which the member would have been entitled at the member’s age at the time of death or at the age of 60, whichever is later.
(b) The annuity provided by this section is payable only to the member’s surviving spouse. If the member is not survived by a spouse, a benefit may not be paid under this section.

- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
(c) An annuity may not be paid under this section if, at the time of death, the member was eligible to select a death benefit annuity under § 814.301.
