Terms Used In Texas Government Code 825.521

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Rule: includes regulation. See Texas Government Code 311.005

In adopting rules governing an appeal authorized by law or rule of a determination or decision of the retirement system by the system’s staff, including a final administrative decision of the system, the board of trustees shall ensure that rules establishing deadlines for filing the appeal afford a member or retiree at least the same amount of time to file the appeal as the retirement system has to issue the determination or decision.
