Terms Used In Texas Government Code 83.005

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005

A person who pays a fee prohibited by this chapter may bring suit for and is entitled to:
(1) recovery of the fee paid;
(2) damages equal to three times the fee paid; and
(3) court costs and reasonable and necessary attorney’s fees.
