(a) In this section, “disability” has the meaning assigned by the Americans with Disabilities Act of 1990 in 42 U.S.C. § 12102.
(b) During the review process under § 166.046(b), the ethics or medical committee may not consider a patient’s disability that existed before the patient’s current admission unless the disability is relevant in determining whether the medical or surgical intervention is medically appropriate.
