(a) An institution shall inform each resident and the resident’s next of kin or guardian of the rights adopted under this subchapter and shall explain the rights to the resident and the resident’s next of kin or guardian. The institution shall provide a written statement of:
(1) all of the resident’s rights; and
(2) any additional rules adopted by the institution involving resident rights and responsibilities.
(b) The institution shall provide a copy of the written statement to:
(1) each resident;
(2) the next of kin or guardian of each resident; and
(3) each member of the staff of the institution.

- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Signed: includes any symbol executed or adopted by a person with present intention to authenticate a writing. See Texas Government Code 311.005
- Written: includes any representation of words, letters, symbols, or figures. See Texas Government Code 311.005
(c) The institution shall maintain a copy of the statement, signed by the resident or the resident’s next of kin or guardian, in the institution’s records.
(d) The institution shall post the written statement in the manner required by § 242.042.
(e) An institution that has been cited by the department for a violation of any right adopted under this subchapter shall include a notice of the citation in the informational materials required by § 242.042(a)(8). The notice of citation must continue to be included in the informational materials until any regulatory action or proceeding with respect to the violation is complete and the department has determined that the institution is in full compliance with the applicable requirement.
