(a) A provider who operates a facility that existed on September 1, 1987, must comply with the filing requirements imposed under § 246.041 and the escrow requirements imposed under Sections 246.077 and 246.078 not later than September 1, 1990.
(b) The commissioner may extend the time for compliance under this section for a reasonable period if the commissioner determines that the provider is unable to comply with this section after making a good faith effort to comply.
