(a) A person commits an offense if the person intentionally or knowingly:
(1) converts to the person’s own use or benefit a controlled substance property or plant seized under § 481.152 or 481.153; or
(2) diverts to the unlawful use or benefit of another person a controlled substance property or plant seized under § 481.152 or 481.153.
(b) An offense under this section is a state jail felony.
